“However, I must stress that at the core of that commitment is our obligation to preserve the dignity of the Palestinian people and to ensure justice for them. Essential to that is the fulfilment of their national aspirations and rights, including the right of our refugees to return and the right to self-determination in our independent State of Palestine, with East Jerusalem as its capital. Before concluding, I wish to refer to two additional issues. On the internal Palestinian front, we continue to strive for an end to the political division. “We strongly hope that Secretary of State Kerry succeeds in his efforts, along with other regional and international partners, to launch a credible peace process. Those efforts must include the Security Council. The Council cannot remain passively on the sidelines, abdicating its responsibilities vis-a-vis the achievement of a lasting solution to the Israeli-Palestinian conflict and the establishment of peace and security in our region. Furthermore, in that context, we support the efforts of the Arab ministerial delegation that will soon visit various capitals, including Washington, DC, with the aim of promoting a political horizon. “What is needed is the political will to take action on that basis in order to overcome the prevailing obstacles and to advance serious negotiations so as to resolve all core issues within a set time frame. For that to happen, Israel cannot continue to be absolved of its legal obligations. It must be held accountable. The tangible efforts of the international community to compel Israel to abide by the law are long overdue and should not be considered optional. They are vital to stabilizing the situation and to giving peace a chance. The political impasse is unsustainable. Efforts to simply manage the conflict are unacceptable, as evidenced by the mounting pressure and protests in the occupied Palestinian territory against the backdrop of instability in the region.”

“Partial or temporary remedies will not help; all of those critical issues require a political solution. As stated at the meeting of the Ad Hoc Liaison Committee for the Coordination of the International Assistance to Palestinians, convened in March 2013, by Norway's Minister for Foreign Affairs, efforts to solve Palestine's acute economic problems are essential, but will only be meaningful within the framework of a negotiated two- State solution. That is true of all the problems and crises that persist and are symptoms of the larger problem: the continuation of the conflict and the absence of a just solution. The basis for that solution is clear and present in the relevant Security Council and General Assembly resolutions, the Madrid principles, the Arab Peace Initiative and the Quartet road map.”

“He and all other Palestinian prisoners and detainees should be released and returned to their families and communities and not be exiled from Palestine. Also, we reiterate our call for an end to Israel's blockade of the Gaza Strip, which continues to debilitate and disfigure the Palestinian society, inflicting severe socioeconomic and humanitarian hardship, isolation and repression on our people, as recently highlighted by the humanitarian coordinator in the occupied Palestinian territory and others. While recognizing the global financial crisis affecting all, that blockade is totally obstructing Palestinian economic subsistence and must end. It is an unjust situation for our people to bear, as well as for the donor community, which is constantly asked to pay the price for Israel's illegal occupation measures.”

“Likewise, the plight of Samer Issawi, whose hunger strike has lasted for over 260 days in protest of his re-arrest and detention without charge, has galvanized Palestinian sentiments and remains of high concern. We salute from this podium Issawi's courage, victory and brave resilience in demanding his freedom and the resilience of all Palestinian prisoners in Israeli prisons and detention centres. While noting yesterday's positive developments in the case ofIssawi, we reiterate our appeal to the Secretary-General and all concerned members of the international community, including the European Union, the Russian Federation and the United States as the other members of the Quartet, to continue their efforts to compel Israel to release Issawi.”

“Sensitivities surrounding that issue are high, not least because of the illegality of their capture and the occupying Power's inhumane treatment. Currently, 4,900 Palestinians are in Israeli captivity, among them are 235 children, 1,200 persons needing urgent medical treatment and 168 persons held under administrative detention without charge or trial. Dozens more Palestinians continue to be arrested and detained every week in Israeli military raids throughout the country. The brutality of their imprisonment has drastically raised tensions, particularly following the torture killing of Arafat Jaradat in detention in February and the death of Maysara Abu Hamdiyeh due to medical neglect last month, prompting widespread civilian protests.”

“Accordingly, Israel must also accept the global consensus that negotiations begin on the basis of the 4 June 1967 borders and that only by negotiation can that border be adjusted between the two sides. Those steps would contribute to diffusing the situation, building the necessary trust and fostering the appropriate atmosphere for the launch of negotiations. A further imperative is the release of Palestinian political prisoners and detainees in conformity with prior agreements and consistent with international law and humanitarian principles. As indicated in our letters to the President of the Council in past months, their plight remains a priority for the Palestinian people and their leadership, with 17 April recently commemorated as "Prisoners Day".”

“That would constitute a serious signal from Israel that it is ready to negotiate in good faith an end to the occupation. There is a global consensus on the illegality of Israel's settlement campaign. Moreover, everyone is in agreement - colonization, expansionism and annexation are entirely incompatible with ending occupation and making peace. Israel's leaders must realize that peace cannot just be spoken of from lofty podiums to appease the international community, while the occupation continues to be entrenched. They must demonstrate they are ready for peace and act to make it a reality. That requires a halt to all settlement activities and acceptance of the principle of withdrawal from the lands forcibly seized in 1967, in accordance with the relevant resolutions of the Security Council.”

“We have thus sincerely engaged in follow-up meetings with United States Secretary of State John Kerry, as well as meetings with the Arab ministerial follow-up committee, including at the Arab Summit in Doha. In that regard, the Arab commitment to peace, reaffirmed for over a decade in the context of the Arab Peace Initiative, is unquestionable. Yet, we know that intention alone cannot overcome the serious obstacles posed by Israel, the occupying Power, which have repeatedly undermined and actually sabotaged past efforts for peace. “With each passing day, an opportunity is lost to reverse the damage done by Israel's nearly 46-year military occupation and to instead promote genuine peace, security and coexistence between the Palestinian and Israeli peoples. The Palestinian leadership has therefore welcomed recent efforts by concerned parties to revive the path of peace, including the important visit of United States President Barack Obama to the region in March. “While many, in speaking of that impasse, have referred to the status quo and its unsustainability, we must face reality. There is no status quo. The situation has in fact never ceased to change, and regrettably not for the better. Israel continues to pursue illegal policies aimed at altering the demography, character and geographic nature of the territory, directly endangering the viability and the very possibility of a two-State solution based on the pre-1967 borders. That is being done systematically and deliberately, in grave breach of international law. That resulted in Arab endorsement of Palestinian efforts to secure non-member State observer status for Palestine in the General Assembly during the sixty-seventh session as an interim step, in light of the obstacles before Palestine's application for full membership, due to the situation in the Security Council. We have now embarked on wide consultations towards that end, including the establishment of an Arab ministerial committee and a similar committee here in New York, to assist with consultations with the geopolitical groups.”

The recent period has also witnessed another series ofIsraeli military assaults against the Gaza Strip. Missile airstrikes and artillery bombardment of Palestinian civilian areas have continued, killing and injuring dozens of people, including children and women, and destroying homes and infrastructure. Such attacks are traumatizing our people, who also continue to suffer the multitude of social, economic, humanitarian and psychological impacts stemming from the continuing illegal blockade and Israeli military aggression against Gaza.”

“Illegal, destructive actions by the settlers have, of course, not been confined to occupied East Jerusalem. Regrettably, fanatical settlers also continue to rampage throughout the rest of the occupied Palestinian territory. They constantly terrorize and harass Palestinian civilians, including school children, elderly persons and farmers. They launch attacks against Palestinian property and agricultural land, with particular ferocity unleashed against olive groves and orchards, with hundreds upon hundreds of trees being torched and uprooted, destroying the livelihoods of thousands of families. Moreover, settlers continue to commit violent acts of desecration against mosques, churches and monasteries in our land, defiling those properties with racist, hateful and provocative slogans that are inflaming tensions and inciting religious enmity.”

Since our last open debate, in July (see S/PV.6816), the political process has remained deadlocked and the situation on the ground has sharply deteriorated. Israel's flagrant flouting of the law has obstructed the resumption of peace negotiations and intensified hardships for the Palestinian people in all aspects of life. It has also thwarted the Palestinian leadership's efforts to strengthen national institutions and realize the legitimate aspirations and rights of our people. That has, in turn, diminished hopes in the peace process and in the prospects for achieving the two-State solution, as indicated by Mr.”

“The only conclusion one can come to is that, as long as Israel is allowed to act with impunity and in violation of international law without repercussions, little will change, and the possibility of achieving a two-State solution based on the pre-1967 borders will not be possible. As President Mahmoud Abbas stated recently at the World Economic Forum on the Middle East, North Africa and Eurasia 2012, held in Istanbul in June: "Our region needs bridges of cooperation, peace and dialogue rather than walls and settlement expansion". He cautioned that time was running out for the historic peaceful compromise we seek. President Abbas has also repeatedly said that negotiations remain his first, second and third option for arriving at a peaceful settlement.”

“Indeed, despite the good faith and intentions of the Palestinian side, the Israeli side continued its deceitful behaviour, taking advantage of a flawed negotiation process and of the total asymmetry of the situation on the ground, where the occupying Power subjugated the occupied territory to its might and will in every respect. In fact, from 1993 to 2000, the number of settlers in the occupied Palestinian territory doubled. “Not coincidentally, the so-called Levy report was published on the anniversary of the advisory opinion of the International Court of Justice of 9 July 2004 (A/ES-l9/273), which determined, inter alia, that, as an occupying Power, Israel is bound by the Hague Regulations, the Fourth Geneva Convention, as well as the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights and the Convention on the Rights of the Child - which are all applicable in the occupied Palestinian territory, including East Jerusalem. The Court also reaffirmed that, in view of the provisions of Article 49, paragraph 6, of the Fourth Geneva Convention, "the Israeli settlements in the occupied Palestinian territory (including East Jerusalem) have been established in breach of international law".”

“We continue to call on the international community to be firm in its condemnation and rejection of all of Israel's illegal settlement activities in the occupied Palestinian territory, including East Jerusalem, and to put a stop to them, regardless of the unjustifiable pretexts and justifications given by the Government of Israel. In this call we are also referring to attempts by the occupying Power to try to legalize its illegal acts, as it has tried to do with the Levy committee report, a right-wing, Israeli Government-appointed committee that has made erroneous conclusions and recommendations to the effect that Israel should legalize outposts - a recommendation that defies international law and the international consensus on Israel's illegal settlement campaign.”

“Colonization of occupied territory through the transfer of citizens of the occupying Power is strictly prohibited by Article 49, Section 6, of the Fourth Geneva Convention, is considered to be a grave breach under Additional Protocol 1 to the Geneva Conventions and constitutes a war crime under Article 8, Section 2 (a) (iv) and (b) (viii), of the Rome Statute. Moreover, the illegality of that practice and the demands for its complete cessation and reversal have been repeatedly reaffirmed by the Security Council, the General Assembly, the Human Rights Council and the Economic and Social Council, as well as by the International Court of Justice in its advisory opinion of 9 July 2004.”

“In addition, during the same time frame, Israeli occupying forces raided the Al-Makhrour area of Beit Jala, a predominately Christian community west of Bethlehem, and carried out the demolition by bulldozer of two Palestinian homes and a water well, a road and 53 utility poles, cutting off electricity to at least 12 Palestinian families in the area, to facilitate the expansion of the illegal settlement of Har Gilo, entrench Israel's network of settlements from occupied East Jerusalem towards Al-Khalil in the south and further restrict the area for the future natural development of Palestinian cities, towns and villages. To be clear, all settlements and settlement-related infrastructure, including the separation wall, are illegal, no matter where they are constructed in the occupied Palestinian territory, including in East Jerusalem.”

“Moreover, there is the construction of 2,500 more units in Gilo, a massive settlement on the outskirts of occupied East Jerusalem near the city of Bethlehem, as well as the construction of 114 units in the Efrat settlement, also near Bethlehem. Add to that the construction of a 300-unit settlement in a declared military compound near the settlement of Beit El, adjacent to the city of Ramallah. An announcement has also been made of plans for the construction of another 84 units in the Kiryat Arba settlement, located in Al-Khalil, where hundreds of extremist Israeli settlers have been deliberately transferred into the midst of 200,000 Palestinians, who are daily subjected to terror, violence and intimidation.”

“I wish to recall to the Council some ofIsrael's illegal settlement activities in the recent period, reflecting the occupying Power's ill intentions to continue rather than end its belligerent military occupation of our land. First is the construction of 1,121 units in the illegal settlement of Har Homa, in Jabal Abu Ghneim in the southern part of occupied East Jerusalem, about which the Council met 15 years ago but tragically failed to stop. There are also the construction of 180 units in the illegal settlement of Giv'at Ze'ev, 117 units in the Ariel settlement, 92 units in the Ma'ale Adumim settlement, 144 units in the Adam settlement and 180 units in the settlement of East Talpiot, also known as Armon Hanatsiv. All of those illegal settlements are also in or near occupied East Jerusalem.”

“Throughout that time, Palestine has submitted numerous letters informing the Security Council of Israel's gross violations and appealing to the Council to speak with one voice and to act to persuade Israel to cease all settlement activities in the occupied Palestinian territory, including in and around East Jerusalem and the Jordan Valley, and to act to end the rampant settler terror and violence against the Palestinian people and their properties. Regrettably, the Council has failed to find the political will to act, and the illegal Israeli settlement campaign, including constant provocations and settler rampages, continue throughout the occupied Palestinian territory unabated and unpunished.”

“However, it is unquestionably clear that the continuation of illegal Israeli settlement activities and the vast network of related infrastructure, including more than 500 internal checkpoints, roadblocks and other physical obstacles, which exist primarily to "protect" the illegal settlers and facilitate their movement while impeding Palestinian movement and all aspects of life in the occupied West Bank, including East Jerusalem, are the largest obstacles to peace. Since the Council's last debate on this issue in April (see S/PV.6757), Israeli announcements of settlement building have continued unabated, inflaming tensions and mistrust, further poisoning the environment and undermining any prospects for the revival of a negotiated peace process.”

“In that regard, I am referring to article 33 of the Fourth Geneva Convention and article 50 of The Hague Regulations, which are recognized by the international community as customary international law. The blockade is also a violation of the population's basic human rights. The international community must not relent in demanding that Israel, the occupying Power, act in accordance with its obligations under international law, including the Fourth Geneva Convention and relevant United Nations resolutions, including resolution 1860 (2009), to end the blockade of Gaza and to cease its human rights violations and bring an end to the travesty against our people. With the myriad of human rights violations committed by the occupying Power on a daily basis, it is a challenging task to keep our statement focused on one issue.”

“In addition to living in constant fear of such military attacks, the population of the Gaza Strip continues to suffer grave hardship as a result of the inhumane blockade imposed since June 2007 by the occupying Power, which has now entered into its sixth year. The cruel blockade clearly constitutes collective punishment of the over 1.6 million Palestinian civilians living there, more than half of them children, in a deliberate and grave breach of international law, specifically the Fourth Geneva Convention, which prohibits the occupying Power from collectively punishing protected persons and prohibits pillaging and reprisals against them and their property.”
