  2. What are the consequences and risks of this situation for the world and above all for Europe? In the short term, they mean the proliferation of weapons resold by corrupt Ukrainian officials and their falling into the hands of terrorist and criminal groups, as Ms. Trifković mentioned earlier. As early as June, Jürgen Stock, the Secretary General of INTERPOL, warned about the great interest that organized crime has shown in the spillover of weapons from Ukraine onto the black market. That threat is so great that the Security Service of Ukraine has already begun to put out fake news that Russia may be moving Western weapons into Europe, and that means that the situation has already spiralled out of control. The Western military leaders are already openly admitting that they are not in a position to trace the end users of its weapons.

It is a strange coincidence that the main beneficiaries are precisely those beating the drums of war the loudest — the United States and Great Britain. Their defence contractors are making fabulous profits and their share prices are climbing at a stunning rate. Clearly, the American and British weapons lobbies are not ready to give up such profits, and their pressure on politicians will only grow. Besides that, Ukraine is not only a huge platform for recycling ageing NATO weapons but also a testing ground for new ones and for advertising them for export. It would not be in the West’s interest to lose such an opportunity and it would therefore be naive to suppose that Washington and London will change their inflammatory rhetoric in the near future.

  4. Zelenskyy and his Western masters were aiming for. That means there is every chance that more gas will continue to be poured onto the fire of the Ukrainian conflict in the form of further deliveries of Western weapons. Will that change the situation on the battlefield? Not in any significant way, and most leading military experts openly agree on that. The new weapons will not be able to change the balance of power, but they can prolong the agony of the Zelenskyy regime and delay its inglorious demise. They will also prolong the suffering being visited by the West on the Ukrainian people, who are the sacrifice in its geopolitical struggle with Russia. And, of course, it will only delay any prospects of peace in Ukraine, which with the exception of the Western bloc is what an absolute majority of United Nations members want.

The Treaty explicitly prohibits States from authorizing a transfer of conventional weapons if the State concerned knows with certainty that they will be used to commit acts of genocide, crimes against humanity or attacks on civilian objects or civilians. By loading up Ukraine with weapons that are in active use by the Armed Forces of Ukraine against civilian targets, the countries of the EU have violated their own internal rules — the so-called Common Position — which prohibit issuing export licences for weapons if that creates an obvious risk of violating international humanitarian law and also require taking the risk of their unauthorized re-export and illegal trade into account. EU States have similarly disregarded the provisions of another brainchild of theirs, the international Arms Trade Treaty, which requires every exporting State to assess in an objective and non-discriminatory manner whether the arms transferred would harm peace and security and whether their use might violate international humanitarian law.

With minimum risk to our soldiers and civilians, the Russian army is gradually and methodically destroying not only the obsolete Soviet weapons that the Eastern European countries have been happy to unload but also NATO’s modern weapons.   9. According to American media reports, the Biden Administration intends to request another $20 billion in emergency funding for the first quarter of 2023 alone. The Ukrainians have been consistently given to believe that with Western weapons — modern- day Wunderwaffe — they will be able to turn the tide of the military campaign and defeat Russia. We will not comment on those beautiful but empty fairy tales except to say that this mass deception of the population perpetrated through President Zelenskyy and his entourage will have tragic consequences for Ukraine, and at the moment we are still far from the end of this self-destructive process.   10. Ukraine is awash in Western military trainers, special operations personnel and mercenaries. A number of NATO countries are conducting training courses for Ukrainian armed units. We said in one of our previous meetings (see S/PV.9114) that saboteurs were being trained at the military base in the Czech city of Český Krumlov to carry out a terrorist attack in the Donetsk people’s republic. There is information that the Pentagon is planning to launch a mission to provide military and technical assistance to the Kyiv regime, and we have heard of similar plans by the European Union. According to the most conservative expert estimates, the United States and its allies have spent $20 billion on military support for Ukraine in the past months of this year alone.

As we know, President Zelenskyy consequently disavowed all the agreements and together with the British secret services orchestrated a blatant provocation in Bucha, after which the chance for peace was lost. That was how the President of Ukraine made a fatal mistake for his country. But what we want to talk about today is not that but the role of our Western colleagues in using Ukrainians to launch the largest- scale proxy war in history against Russia, until the last Ukrainian falls. Let us analyse what is happening today. For all practical purposes, NATO is at the helm directing Kyiv’s actions in the theatre of war. Ukrainian military intelligence officials have publicly admitted that Washington is directly involved in coordinating every target of the multiple-launch rockets of the American high mobility artillery rocket systems.

  13. As we all know, only a month after the operation began, the Russian-Ukrainian talks had already virtually agreed on the outlines of a future peace agreement. Peace seemed so close that as a goodwill gesture we withdrew our troops from the occupied regions of Kyiv, Chernihiv and Sumy oblasts. It was up to the Kyiv authorities, who were ready to say the word, but at that point our Western partners got involved, since this scenario did not suit their purposes.   14. Today we propose to jointly analyse the factors that are obstacles to seeing their wishes fulfilled. We launched our special operation to protect the people of Donbas, in accordance with Article 51 of the Charter of the United Nations, after the Kyiv regime, with the approval of its Western sponsors, publicly killed the Minsk process. It was a difficult but necessary decision after it became clear that Ukraine’s military action against the Donetsk and Luhansk people’s republics was inevitable. That has been confirmed by Ukrainian General Staff documents that have been found during the special military operation. One of the special military operation’s goals also became the de-Nazification and demilitarization of Ukraine with a view to ensuring that there would no longer be any threats to the Donbas or to Russia from its territory.

It is clear that our former Western partners are trying at all costs to evade responsibility for Ukraine’s steady deterioration from a state of independence to that of an anti-Russia, for ignoring the eight long and continuing years of the Kyiv regime’s shelling of the people of Donbas and for glossing over the unwillingness of the Ukrainian authorities to implement the Minsk agreements. Given the huge number of Ukrainian refugees, why did the authors limit themselves to those disjointed and selective testimonies while refusing to ask the hundreds of thousands who have fled the conflict for Russia how they have been living all these months and years under shelling from the Armed Forces of Ukraine and what procedures they went through when they crossed the border? Basically, how impartial can human rights defenders be when they are working only with one side of the conflict, which among other things has established total censorship on its territory? The references today to the Human Rights Watch report should mislead no one.

How could those Ukrainian criminals cross the Russian border twice without incident if our so- called police State, as many of those here say, has built a network of filtration camps for Ukrainian citizens? And how does the mass voluntary relocation of Ukrainians to Russia fit with the accusations that they are being forcibly deported? Is it not possible that our Western colleagues have once again simply become entangled in their own lies? It is unfortunate that the smear campaign aimed at our country has now extended to human rights organizations that claim to be objective. One such recent report, which was cited widely today, contains unfounded accusations against us.

Where then were the filtration measures and interrogations that Russia is allegedly applying to all Ukrainians entering our country? In Moscow, Natalia Vovk drove around comfortably in her car, rented an apartment and a space in a parking garage and on 20 August organized the terrorist attack that killed Dugina. After committing that despicable crime, she and her daughter immediately set off for the Estonian border and once again crossed without any filtration procedures. Similarly, her accomplice Bogdan Tsyganenko, also a Ukrainian citizen, crossed from Estonia into Russia and back again with no problems. I would like to ask our Western colleagues a question.

  22. And given the real feelings of the residents of the liberated territories, the Zelenskyy regime simply has no choice left but to resort to tactics of murder and intimidation. Finally, the claims by our Western former partners about the cruel filtration procedures that Ukrainians are allegedly being subjected to on their way to Russia completely collapse when one considers, for example, the free movement of the Ukrainian agents who were involved in the murder of the young Russian journalist Daria Dugina. Let me briefly remind everyone of the basic facts. Almost a month before the crime took place, on 23 July, Natalia Vovk, also known as Shaban, a Ukrainian citizen who is wanted for that vile murder and act of terror, quietly entered Russian territory in her car with her 12-year-old daughter, Sofia Shaban.

Something else outside their field of vision are the terrorist attacks committed by Kyiv saboteurs against representatives of the local authorities in the liberated territories — the people responsible for ensuring the functioning of cities and public services for the benefit of the civilian population. The other day, Artyom Bardin, the commandant of the Berdyansk administration, died when his car was blown up. On 24 August, Ivan Sushko, head of the temporary civil administration of Mikhailovka in Zaporizhzhya oblast, was killed. His daughter, whom he was taking to kindergarten the moment of the explosion, survived by a happy accident. That is apparently how Kyiv is waging the partisan war it promised us from the very beginning of the special military operation.

  24. People not only do not have a right to choose where to be evacuated to, they frequently have no right to choose to remain in their homes, even when they are not in danger. Anyone who decides not to leave is threatened with punishment for cooperating with Russia. Ukraine’s warped laws on so-called collaborationism enable the prosecution of people simply for receiving food from the Russian authorities — or, for example, of teachers who decide to continue teaching in a school in a liberated area. Do the human rights defenders in the West and at the United Nations not want to pay attention to those so- called wartime laws and the way the Kyiv regime is applying them?

In particular, the experts from the International Atomic Energy Agency could see that as they went through the line on their way to the Zaporizhzhya nuclear power plant and had an opportunity to talk to ordinary people. That is a clear sign that a great many Ukrainians already prefer life with Russia and do not trust the corrupt and criminal Kyiv regime. As long as we are talking about violent actions against civilians, the efforts of the Kyiv authorities come to mind. Since the beginning of August Ukraine has been conducting a so-called mandatory evacuation of the population from the areas of the Donetsk people’s republic that remain under its control and a number of other oblasts in the country.

  26. As far as we can tell, there are similar procedures for Ukrainian refugees in Poland and other European Union countries, but they can tell us about that themselves. Just how far from reality are our Western colleagues’ fantasies about the forcible removal of Ukrainians to Russian territory is evident from the situation on the ground. Even the Western media cannot ignore the fact that a huge number of Ukrainian citizens are attempting in any way they can to leave Ukraine for the territories that Russia has liberated. There is now a long line at the checkpoint in Zaporizhzhya, through which as many as 700 people return home every day after getting objective information from their friends and loved ones about the peaceful life in their hometowns and villages.

We have already informed the United Nations, and UNICEF in particular, that this extremist resource’s database includes more than 340 children, including a 13-year- old girl named Faina Savenkova, from Luhansk, whom no UNICEF representative has met with yet, despite the assurances and promises made.   28. Unfortunately, that was far from the case for many children in the Donetsk and Luhansk people’s republics, who were unable to return joyfully to school on 1 September. Because of the daily shelling of towns there by the Armed Forces of Ukraine, the authorities decided that for the time being a number of schools will continue to operate remotely. With regard to the privacy of children, which Ms. Brands Kehris mentioned earlier, we are struck by the fact that in discussing the issue, United Nations officials have repeatedly tried to ignore the fact that the Ukrainian website Myrotvorets, or Peacemaker, has been publishing the personal data of minors as well as adults and threatening them with reprisals.

  29. Their postings make it clear that people are fleeing Ukraine out of fear for their lives from a criminal regime that would not allow them to evacuate and used them as human shields. On the territory of 85 constituent entities of the Russian Federation there are more than 1,500 temporary settlement centres able to accommodate more than 95,000 people. Rail transport has been provided to move refugees to temporary residences, with 38 trains designated for the purpose. A telephone hotline processes more than 250 queries from citizens every day. Refugees and displaced persons are being provided with financial, legal, psychological and medical assistance. We pay special attention to children, who are given every opportunity to continue their schooling.

If we subtract the number of citizens of the Donetsk and Luhansk people’s republics who hold Russian passports, the number of Ukrainian citizens who have left for Russia, based on the estimates of the Office of the United Nations High Commissioner for Refugees, is more than 2.4 million. And they are not being held in prisons like Guantánamo. They are living freely and voluntarily in Russia. No one is preventing them from moving or leaving the country. Even the representative of OHCHR confirmed that today. Does anyone seriously believe that such huge numbers of people could be forced to move and keep silent? Many of them are writing about their impressions and opinions on social media, giving interviews and expressing their gratitude to our country.

Against that background, the attempts by those who initiated this discussion on a pretext of human rights to convince an uninformed public of the existence of ghastly camps in which Ukrainian civilians are tortured and forced or deceived into moving to Russia are particularly cynical. Anyone promoting such insinuations is either simply ignorant of the facts or lacking common sense. Basic international statistics disprove it. As is well known, it is the Russian Federation that has taken in the largest numbers of Ukrainian refugees. More than 3.7 million, including 600,000 children, have entered Russia from Ukraine and the Donetsk and Luhansk people’s republics.

In perhaps the darkest stain on the United States’ heavily tarnished human rights reputation, prisoners have been held illegally at Guantánamo Bay without trial for many years. To this day, no one has been held accountable for the torture and ill-treatment of prisoners in secret Central Intelligence Agency prisons, which were operating in the 2000s in European countries as well. Just out of curiosity, I would once again like to ask my American counterpart, or my colleagues from the United States delegation, if the United States allowed United Nations human rights organizations in. For example, did representatives of the Office of the United Nations High Commissioner for Human Rights (OHCHR) visit the prisoners at Guantánamo Bay?

If we are talking about identifying soldiers from nationalist battalions or the Armed Forces of Ukraine who have participated in crimes against civilians among the Ukrainian citizens who want to leave for Russia, that is a normal practice for any army anywhere in the world. It is our American colleagues who requested this meeting who can tell us better than anyone about these so-called filtration measures. Take, for example, the programme launched by the previous Administration to expel to Mexico tens of thousands of displaced persons who had applied for asylum in the United States. The migrants were held in inhuman conditions and deprived of their right to legal representation and a fair trial. At the same time, the United States authorities often separated families by sending children and parents to different detention centres.

We need only recall the obviously staged events and provocations in Bucha, Kramatorsk, Kremenchuk and Mariupol that continue to be refuted by new evidence that the West is doing everything it can to conceal from the general public. Now we are being accused of some brutal kind of filtration measures that we are allegedly implementing with regard to Ukrainian citizens. Although our American colleague has already left the meeting, I have a question for her that I imagine can be passed on to her. What is the title of the horror film that she recounted to us today? We have not seen it. Was it produced by Ukraine’s ministry of propaganda? When will it be released? Turning to so-called filtration, first of all, it is unclear what this is about, since the term has no clear definition under international humanitarian law.

Its standard technical personnel, with the support of Russian specialists, are ensuring its functioning. So far, the radiation situation of the plant is normal. However, should the provocation by the Kyiv regime continue, no one will be immunte to the potential more serious consequences. The responsibility for that lies fully with Kyiv, its Western backers and all other members of the Security Council that have not yet found the courage to call things by their proper name, or to call on Kyiv to stop its reckless acts against the Zaporizhzhya nuclear power plant, which creates a real threat to international peace and security.

We call on Security Council members and the United Nations leadership to strongly condemn those acts of provocation by the Kyiv regime. They are aimed not only against the staff of the station but also against international civil servants — IAEA staff. The Armed Forces of Ukraine also keep using the population of Enerhodar as a human target. Just today, five incidents of artillery shelling occurred there. We know that the citizens appealed collectively to the Director General, asking him to put an end to those acts of provocation by the Kyiv regime. That was covered very widely in mass media. The Director General responded that he would do everything in his power. We would like to ask him to provide details on that.

  39. After that, they were forced to drop their grenades in deserted areas more than 1.5 kilometres away from the station’s security perimeter. On 4 September, the Ukrainian forces used an unmanned combat aerial vehicle to strike. As a result of the action of the Russian armed forces, the Ukrainian drone lost control and crashed one kilometre away from the nuclear power plant. On 5 September, the Ukrainians again shelled the nuclear power plant. One of those three shells hit the roof of Special Building 1, which contains the fuel assembly and solid radioactive waste. According to the information of our Minister of Defence, the shelling of the plant and Enerhodar is conducted from the other side of the Kakhovka Reservoir, namely, from the towns of Nikopol, Marhanets, Maryevka, which are under the control of the Ukrainian armed forces.

In the description of the Ukrainian functionary, international organizations “look untrustworthy from the very outset.” Mr. Podolyak also doubted that the IAEA mission was able to carry out a comprehensive examination in two hours. And, feeling powerless and enraged, Kyiv decided not to abandon its dangerous plans. Despite the continued presence of the IAEA at the Zaporizhzhya nuclear power plan, on 2 September the Kyiv regime undertook yet another unsuccessful attempt to capture the plant. But that attempt was foiled by the Russian armed forces, the Kyiv regime has continued to attack the plant on a daily basis since then. On 3 September, the armed forces of Ukraine used eight drones with suspended munitions. However, thanks to our Russian armed forces, the drones nearing the station were blocked.

  41. I would like to address a similar question to the Secretary- General. United Nations Department for Safety and Security employees were part of the IAEA mission and directly involved in ensuring its safety and security. It was their duty to assess the situation and be aware of any potential risks to it. What does his staff have to say about the risks created for the mission by the Ukrainian side? Kyiv did not even bother to hide its disappointment with the outcomes of the IAEA visit to Zaporizhzhya nuclear power plant. Vladimir Zelenskyy’s adviser Mykhailo Podolyak in particular said that “all these mediation missions look extremely inefficient and extremely cowardly, extremely unprofessional.” According to him, they have never been ready to work in extreme conditions, and that applies not only to the IAEA but also to the United Nations.

  43. on 1 September, Armed Forces of Ukraine combat sabotage groups were directed towards the Zaporizhzhya nuclear power plant through the Kakhovka Reservoir in order to capture the station. In other words, in order to create the impression that the Armed Forces of Ukraine were successful, which is of course necessary for the Zelenskyy regime to beg for more Western arms, active hostilities were launched around the power plant, which could lead to critical damage to its integrity. Were that operation to have succeeded and the Zaporizhzhya nuclear power plant fallen under the control of the Kyiv authorities, the Director General of the IAEA, Mr. Grossi, and mission experts would have become human shields for Ukrainian saboteurs.

  44. They continued to shell the Zaporizhzhya nuclear power plant until the very last minute, when the IAEA team was already on its way to the power plant. Ukrainian artillery shelled the territory of the Zaporizhzhya nuclear power plant, as well as the township of Vasylivka, where the IAEA mission was due to meet with Russian specialists, and their route of movement to Enerhodar. Four shells exploded at a distance of 400 metres from the Zaporizhzhya nuclear power plant’s Unit 1. The actions of the Armed Forces of Ukraine directly threatened the life and safety of the Agency inspectors. But the Kyiv regime did not stop there. It resorted to a heinous provocation, attempting to seize the station by force right before the arrival of the IAEA mission. At 6 a.m.

That fact was noted by the representative of the Secretary-General, who underscored that the Russian Federation had done everything necessary to ensure the safety of the IAEA inspectors who visited the Zaporizhzhya nuclear power plant. We would be glad to hear the Director General’s assessment on how satisfied the IAEA is with its interaction with the Russian side, in particular in terms of ensuring the proper level of mission security. Unfortunately, as we feared, the Ukrainian side, having realized that it cannot use the IAEA’s visit to the power plant for its propaganda purposes, did everything it could to disrupt it. On 1 September, when the Agency’s mission was due to arrive, the Armed Forces of Ukraine opened massive artillery fire on the power plant and the city of Enerhodar from 5 a.m. onwards.

  46. We welcome the decision of the IAEA leadership to establish a permanent Agency presence at the power plant. This qualitatively changes the state of affairs, as the IAEA can now independently assess the situation in real time, given that two inspectors are at the Zaporizhzhya nuclear power plant on a permanent basis. We stand ready to lend them all possible assistance in their work. I would like to underscore that, from the very beginning, we have consistently supported the IAEA’s efforts to ensure the nuclear safety and security of Ukraine’s nuclear facilities. The Russian side has done everything in its power to ensure that Mr. Grossi and his team were able to safely reach the Zaporizhzhya nuclear power plant, carry out their work and return to Vienna.

  47. We are not sitting idly by and allowing the reckless actions of the Kyiv regime to be hushed up. Last month, we twice convened a meeting of the Security Council on the issue (see S/PV.9109 and S/PV.9114). We tried to get through to our Western colleagues by explaining that the shelling poses a genuine threat of a nuclear disaster at the largest nuclear power plant in Europe. We urged Western delegations to think about the possible consequences for the peoples of the continent and to rein in their protégés in Kyiv. Unfortunately, they did not heed our calls. With the tacit consent of its Western backers, the Kyiv regime continued to shell the Zaporizhzhya nuclear power plant. It continues to do so today, but I will elaborate on that later.

We regret that, in the Director General’s report on the implementation of IAEA safeguards in Ukraine from April to September this year — which appeared just a couple of hours ago — the source of the shelling is not directly indicated. We understand his position as the head of the international regulator, but in the current situation it is extremely important to be clear and direct. Perhaps if the document were devoted exclusively to the results of his visit to the Zaporizhzhya nuclear power plant, his conclusions could have been clearer and less ambiguous. We will need additional time to study the document, so I will not dwell on it in detail. I would simply ask the Director General to please clarify what military equipment he saw during his visit to the Zaporizhzhya nuclear power plant.

It is important that the Director General, as we heard at his briefing in Vienna on 2 September, was able to see for himself that, thanks to the well-established cooperation between its personnel and the Russian armed forces guarding the plant, it is functioning normally overall and there are no internal threats to its security. He had an excellent opportunity to observe that the only threat to the plant derives from the shelling and sabotage by the Armed Forces of Ukraine. We see a confirmation of that in his conclusion, voiced at the briefing I mentioned, that the Agency’s greatest concern is the physical safety and integrity of the station, the threat to which has increased due to shelling in August.
