China applauds the important contributions made by the United Nations Mission in South Sudan to the maintenance of peace and stability in the country, supports the renewal of the Mission’s mandate and continues to provide assistance to facilitate the implementation of the Revitalized Agreement and the peace process so that the people of South Sudan can reap peace dividends as soon as possible. As in the past, China will support the peace process in South Sudan and provide assistance as required. We stand ready to work with the international community constructively to help South Sudan maintain peace and stability and achieve socioeconomic development. The international community should intensify coordination with IGAD and the African Union, support their mediation efforts and help all parties in South Sudan build greater mutual trust and show more responsibility and goodwill so that consensus can be reached as soon as possible on all outstanding issues. Thirdly, humanitarian and economic assistance to South Sudan must be maintained. At present, the focus should be on helping South Sudan address its development problems, assisting the return and resettlement of persons in camps for internally displaced people and expanding investment in areas such as agriculture, energy, infrastructure, education and medical services to help the people of South Sudan rebuild their homes and resume development efforts.

  4. First, it is important to fully respect the leadership of the Government of South Sudan. The parties in South Sudan are primarily responsible for implementing the Revitalized Agreement on the Resolution of the Conflict in the Republic of South Sudan. International partners should strengthen engagement and communication with South Sudanese parties, especially the Government, listen to and heed their input and suggestions and provide financial, material and technical support to ensure stability and security, as needed by South Sudan. Secondly, it is vital to continue supporting the Intergovernmental Authority on Development (IGAD) in its role as the main player in the area of mediation.

  5. I shall now make a statement in my capacity as the representative of China. China thanks Special Representative of the Secretary-General David Shearer for his briefing. I also listened carefully to the briefing made by Ms. Sunday. The political process in South Sudan has recently made positive headway. China welcomes the establishment, on schedule, of a transitional coalition Government and congratulates South Sudan on that achievement. We commend the leadership and courage demonstrated by the leaders of South Sudan. That marks an important step forward in the country’s peace process with the active mediation by the international community, especially by the African countries and regional organizations concerned. In that regard, I would like to highlight the following three points.

  7. All countries are entitled to voice their opinions, make recommendations on issues and determine their voting positions independently, in accordance with their own principled positions. China rejects the levelling of frivolous accusations against other countries, which constitutes an abuse of the Security Council platform. A political solution is essential for improving the humanitarian situation in Syria and must be based on safeguarding the sovereignty, independence, unity and territorial integrity of Syria. China supports Special Envoy Pedersen’s efforts to reach a Syrian- led and -owned solution and to use the platform of the Constitutional Committee in the search for a political solution that addresses the concerns of all parties in accordance with resolution 2254 (2015).

  8. China resolutely supports the efforts of the legitimate Syrian Government to maintain its sovereignty, independence, unity and territorial integrity. That is also conducive to peace and stability in the Middle East. China has consistently supported the comprehensive and impartial management of the Syrian humanitarian issue. It has consistently advocated the humanitarian principles of neutrality, impartiality, independence and non-interference with regard to the delivery of humanitarian aid to Syria. Those principles are widely accepted by the international community and are indisputable. China has consistently played a constructive role in the Council’s discussions of the Syrian humanitarian issue.

  9. China has also cooperated to that end with eight agencies, such as the International Committee of the Red Cross, and has done all it can to help Syria’s neighbours to manage their refugees. China intends to continue helping the Syrian people, including Syrian refugees outside of Syria. China categorically rejects the accusation made by the United States. Since the start of the Syrian crisis, China has been committed to diplomatic efforts to push for an early conclusion to the conflict and a political solution to the Syrian issue. China has no ulterior motives with regard to the Syrian issue. We are guided by the best interests of the Syrian people. We have made judgments and established our positions based solely on the merits of the case.

  10. The Syrian Government agreed to the World Health Organization’s use of border crossings and multiple airports under Government control for shipping supplies. It also authorized the use, by the Syrian Red Cross and other United Nations humanitarian agencies, of roadways for transporting medical supplies in Syrian territory for the purpose of delivering aid. OCHA should accept that Syrian proposal. China is closely monitoring the humanitarian situation in Syria. Since the start of the Syria crisis, China has delivered multiple batches of food aid to Syria and has provided medical services, power equipment, office facilities, public transportation and personnel training in various areas relating to the delivery of humanitarian aid.

  11. Thirdly, the Syrian Government has the primary responsibility for improving the humanitarian situation in Syria. The Office for the Coordination of Humanitarian Affairs (OCHA) and other humanitarian agencies must strengthen coordination and cooperation with the Syrian Government; abide by the Charter of the United Nations; observe the humanitarian principles of neutrality, impartiality and independence; and fully respect the sovereignty and territorial integrity of Syria. The cross-border humanitarian aid delivery mechanism is a special modality for relief in certain situations and should be adjusted to developments on the ground. In a letter to the President of the Council and the Secretary-General, the Permanent Representative of Syria expressed his willingness to accept the delivery of humanitarian assistance.

  12. Secondly, terrorist forces must be eliminated if we are to put an end to the Syrian conflict. The international community should fully cooperate in a joint effort to bring terrorists to justice. The occupation of Idlib by terrorist forces and their systematic attacks on civilians, journalists and medical workers, as well as the acute problem of foreign terrorist fighters, are major obstacles to the restoration of peace and stability in Syria. We should work to eliminate the entrenched terrorist safe havens in Syria, in accordance with the relevant Council resolutions and international law. China supports all parties in their continued efforts to seek a comprehensive and long-term solution to the Idlib problem through dialogue and negotiation.

  13. First, the international community should provide the United Nations with adequate funding and supplies and continue to deliver humanitarian aid to civilians throughout Syria. Years of war have led to harsh living conditions for the Syrian people, who do not have the means to buy fuel, food and medicine. The international community should continue to provide Syria with necessary assistance. In addition, efforts must be made to stabilize the country’s economy in order to secure the Syrian people’s basic livelihoods. In areas with relatively stable security, the Syrian Government is rebuilding houses and medical and educational facilities and clearing the explosive remnants of war. Those efforts are conducive to addressing the humanitarian situation in Syria.

Mr. Wu Haitao (China) (spoke in Chinese): China welcomes the visit to New York of the Deputy Prime Minister and Minister of Finance and Development Cooperation of Belgium in order to preside over today’s meeting. We thank Under-Secretary-General Mueller and UNICEF Executive Director Fore for their briefings. China supports the United Nations in continuing its effective delivery of aid to Syrian civilians. The political, economic and security situations in Syria are complicated and its humanitarian situation remains dire. The international community should increase its humanitarian aid to Syria. The United Nations and the Security Council must apply integrated measures to handle the Syrian humanitarian crisis in a comprehensive and impartial manner. In that connection, I would like to emphasize the following points.

As a party to the NPT, China has always firmly upheld the universality, validity and authority of the Treaty, remained committed to advancing the NPT review process and made unremitting efforts to push forward the process of nuclear disarmament, safeguard the nuclear non-proliferation regime and promote the peaceful uses of nuclear energy and related international cooperation. China has always kept to the path of peaceful development and pursued an independent foreign policy of peace and a defensive national defence policy.   16. We will update and improve the national compliance report and submit it to the tenth Review Conference. China actively participates in cooperation among the nuclear quintet — the Council’s five permanent members (P-5). At the annual P-5 conference in Beijing in 2018, we urged the parties to clearly define the future direction of cooperation. At this year’s P-5 conference in London, China held in-depth discussions with the other four nuclear-weapon States, the NPT Bureau and other relevant parties on the issue of maintaining the Treaty mechanisms. The P-5 working group on nuclear Terminology, led by China, has made important progress and will submit a new version of the nuclear glossary to the tenth Review Conference. The P-5 reached a series of cooperative initiatives to help the tenth Review Conference achieve success.

  17. Preventing the proliferation of nuclear weapons should not undermine the legitimate right of all countries, particularly developing countries, to the peaceful uses of nuclear energy. The International Atomic Energy Agency should play an active role in promoting exchanges and cooperation among countries in the peaceful uses of nuclear energy and in promoting common development and prosperity. China has earnestly implemented the provisions of the Treaty and the outcomes of previous Review Conferences. At the third session of the Preparatory Committee for the tenth NPT Review Conference, we submitted a national compliance report that comprehensively expounds on our policy propositions and compliance achievements in connection with the Treaty’s three pillars.

We must promote political solutions to regional nuclear hotspot issues and support the full and effective implementation of the Joint Comprehensive Plan of Action, the dialogue process between the United States and the Democratic People’s Republic of Korea on the denuclearization of the Korean peninsula, the implementation of the outcome documents of successive NPT Review Conference, and the decision to establish a zone free of weapons of mass destruction in the Middle East. Fourthly, we must fully tap the potential to promote the peaceful uses of nuclear energy and related international cooperation. The peaceful use of nuclear energy is an inalienable right conferred upon the States parties by the Treaty.

  19. Nuclear disarmament should be guided by the principles of maintaining global strategic stability and undiminished security for all. The countries with the largest nuclear arsenals should extend their bilateral nuclear disarmament treaties and make further drastic and substantive reductions of their nuclear weapons so as to create conditions for other nuclear-weapon States to join the nuclear disarmament process. Thirdly, we must strengthen the nuclear non-proliferation regime and eliminate the risk of nuclear-weapons proliferation. The proliferation of nuclear weapons has complex root causes and requires an integrated approach to tackle the symptoms and the root causes. The authority and universality of the international nuclear non-proliferation regime must be strengthened. We must abandon double standards and selectivity.

We should safeguard the existing multilateral arms-control and disarmament mechanisms, including those of the United Nations and the Conference on Disarmament, and oppose treaty withdrawals and violations. We must work together to set up rules and regulations in new areas, such as outer space, cyberspace and artificial intelligence, in order to meet the new challenges to strategic security. Secondly, we must stay the course when it comes to progressive nuclear disarmament and effectively reduce nuclear risks. The nuclear-weapon States should take effective measures to reduce the role of nuclear weapons in national security strategies, reiterate the concept that a nuclear war cannot be won and must not be fought, and exercise restraint in strategic capacity-building and deployment.

In these new conditions, the ongoing strengthening of the NPT mechanisms and the balanced advancement of the Treaty’s three pillars — nuclear disarmament, nuclear non-proliferation and the peaceful uses of nuclear energy — are of the utmost importance to the maintenance of international peace and security and the promotion of human progress and development. To that end, China proposes the following. First, we must adhere to multilateralism and safeguard the international order based on international law. We should maintain a common, integrated, cooperative and sustainable security concept, taking into account the legitimate security concerns of all parties and seeking common and universal security.

The NPT is the cornerstone of the international nuclear disarmament and non-proliferation regime, an important component of the post-war international security system and a key institutional guarantee for advancing nuclear disarmament, preventing nuclear proliferation and promoting greater benefit from nuclear energy for humankind. This year marks the fiftieth anniversary of the entry into force of the Treaty and the twenty-fifth anniversary of its indefinite extension.

  24. China has concerns as to the rushed amendment of the designation criteria at the level of the Security Council. Lastly, China would like to emphasize that most of the members of the Council, including China, would like to see an early launch of the political process in Yemen. We would not like to see Yemen entangled in the complex situation of the region. The sanctions measures and the work of the Sanctions Committee should serve the overall objective of reaching a political settlement, be more constructive and prevent any further escalation of tensions.

  25. All parties should, first of all, engage in adequate discussions at the level of the Security Council Committee established pursuant to resolution 2140 (2014). Secondly, the draft made some unnecessary amendments to the designation criteria. China agrees with the concern expressed over the recruitment of child soldiers and conflict-related sexual violence in the light of the actual situation. But the recruitment of child soldiers and sexual violence in conflict are already included in the existing resolution under the criteria of violations of international human rights law and international humanitarian law. The separate listing of these two acts has not been fully discussed by the Sanctions Committee and is not in accordance with the practice of the Committee.

  26. Regrettably, the resolution just voted on failed to address China’s concerns. As such, China could not but abstain in the voting, for the following reasons. First, the draft requires the Panel of Experts to study and develop a list of commercially available components used to assemble unmanned aerial vehicles. This mandate is excessively broad. The latest text has placed some limitations on the mandate but clearly states that this request should not have an adverse impact on legitimate commercial activities. The Panel of Experts should strictly abide by its mandate and ensure that its work is aimed at effectively limiting the activities of the sanctioned entities and individuals and avoiding any abuses.

  27. Mr. Wu Haitao (China) (spoke in Chinese): The situation on the ground in Yemen has worsened recently. The achievement of a political settlement faces challenges and the humanitarian situation remains dire. Given that extending the Security Council’s targeted sanctions against Yemen and the renewal of the mandate of the Panel of Experts on Yemen are conducive to advancing the political settlement of the Yemeni issue, China is, in principle, in favour of this and hopes that the Council will adopt a related technical rollover resolution. Over the past few days, China took an active part of the consultations on resolution 2511 (2020) and proposed many amendments to the text, in the hopes that it would reflect the broadest possible consensus of the members of the Council, avoid introducing complex factors and maintain the unity of the Council.

  30. We hope that the members of the Committee will demonstrate their political will, uphold the spirit of compromise and play a constructive role in reaching consensus among all parties in Syria. Secondly, terrorism in Syria must be eradicated in order to create a favourable security environment for advancing the political process. Rampant terrorism has significantly undermined prospects for a serious political process and a better future for the country. As such, it must be taken seriously and be addressed by all parties. Idlib has become a breeding ground for terrorism, and the acute problem of foreign terrorist fighters has had substantial knock-on effects.

  31. A political solution is the only way to end the Syrian crisis and must be based on maintaining Syria’s sovereignty, independence, unity and territorial integrity. The establishment of the Constitutional Committee was a good start for the Syrian political process. Its role should be fully leveraged on the basis of the existing outcomes. Differences among Syrian parties in the work of the Constitutional Committee, while unavoidable, should be resolved through dialogue. We should pay particular attention to maintaining the independence of the Committee’s work and creating the conditions necessary to enable all parties in Syria to narrow their differences and build consensus.

We note that in December last year, the Normandy Four summit was successfully relaunched and the parties reached an important consensus on the implementation of the Minsk agreements, which is a clear indication that the Normandy format retains the full support of all the parties and remains the key to the political mediation of the Ukrainian crisis. In February 2015, the Minsk agreements were signed and subsequently endorsed by the Security Council in resolution 2202 (2015). China believes that the agreements have played a vital role in the political mediation of the Ukrainian crisis. Over five years, their authority has been fully recognized by all parties. The various mechanisms related to the implementation of the agreements have generally functioned smoothly.

  36. That is the only way in which we can truly prevent and resolve conflicts and avoid creating further differences and divisions. Efforts should be made to enable the people of the world to enjoy the same vision of peace and prosperity and to facilitate the building of a community of shared future for humankind. The basic principles of international law, such as adhering to the peaceful settlement of international disputes and prohibiting both the threat and use of force, constitute the core of the Charter of the United Nations, which underpins the contemporary international order and other obligations under international law that countries must abide by. They embody the authentic meaning of the rule of law at the international level. As the cornerstone of the international security architecture, the Council must shoulder the lofty responsibility of upholding international law and the basic norms governing international relations. It needs to effectively advance political settlements, support good offices and mediation, maintain unity and cooperation and ensure the implementation of relevant resolutions.

  38. Security sector reform and disarmament, demobilization and reintegration efforts should be carried out in order to advance the transitional justice process. Economic and social measures, such as poverty eradication and job creation, should also be adopted in order to promote peace, achieve national reconciliation and eliminate the latent threats of conflict. The rule of law and justice must be highlighted at both the national and the international levels. Many of the ongoing conflicts in the world today have remained unresolved for decades, with ever-deepening rifts between the parties — a deplorable situation. Such difficult situations often represent the bitter consequences of breaching international consensus and disrupting the international order based on international law.

The Peacebuilding Commission, as a body jointly established by the General Assembly and the Security Council, with the advantage of straddling both the political security and development areas, has an important role to play in that regard. Thirdly, the nexus between transitional justice and the political process, economic development and social integration should be viewed through the correct lens and integrated measures should be taken to promote the rule of law and judicial justice. Transitional justice is not only a legal issue but should also contribute to establishing lasting peace and stability, economic development and social progress in the country concerned, as well as the long-term well-being of local populations.

  40. Only by adhering to the principle of sovereignty can transitional justice efforts be justified, thereby winning the trust of the countries concerned and promoting peace and development. Secondly, it is necessary to help the countries concerned enhance their capacity-building, with a focus on the effective functioning of their judicial systems. In the long term, no special interim measure or external measure can substitute an effectively functioning domestic judicial system. After an extended period of turmoil and conflict, the rule of law of a given country will have been seriously affected and it must be faced with shortages and challenges in financial, technological and human resources.   41. The issue of transitional justice is a key component of peacebuilding. It should be addressed in the context of peacebuilding and sustaining peace and its discussion should be strictly limited to in-conflict and post-conflict situations. First, based on the Charter of the United Nations and universally recognized international law, it is imperative to respect the sovereignty and territorial integrity of every country. It is important to respect the countries concerned in their efforts to advance their transitional justice processes step by step, in a manner consistent with their own national conditions. No models should be imposed from outside, or should any interference be permitted in their internal affairs or struggles.

  42. Mr. Wu Haitao (China) (spoke in Chinese): China welcomes and thanks you, Mr. Minister, for presiding over this open debate. We thank Ms. Bachelet, United Nations High Commissioner for Human Rights, as well as Mr. De Roux and Ms. Sooka for their briefings. Some conflict-affected countries and regions are currently faced with the arduous task of post- war reconstruction. Their conflict-weary populations eagerly look forward to an early restoration of the rule of law and justice so that they can embark on the road towards sustainable development. The United Nations peacebuilding architecture is committed to coordinating the international community’s support for the reconstruction of post-conflict countries and has played a positive role in consolidating the fruits of peace and achieving sustainable development in the countries affected.

China supports the African Union and the League of Arab States in bringing their unique influence to bear on a political settlement to the Libyan question and in working in synergy with the United Nations. In the implementation of the outcome of the Berlin Conference and the Council’s resolution, the international community should remain highly vigilant against terrorism in and around Libya, resolutely combat all forms of terrorism in the country and prevent the cross-border movement of foreign terrorist fighters. We must prevent Libya from becoming a breeding ground for terrorism, the spread of which can jeopardize the country’s peace process.

  44. In the light of that, we adopted resolution 2510 (2020), on which China voted in favour. China takes note of the fact that the resolution was not adopted unanimously. We believe that the views of all sides should be fully respected during consultations in order to reach consensus and maintain the unity of the Council. That is the only way for the resolution to yield the maximum positive effect. We hope that all parties in Libya, relevant countries in the region and the international community will work together for the earnest implementation of the Berlin outcome. In that process, the Secretariat should develop a plan of action that fully reflects the leadership and ownership of Libyans, accommodates the concerns of all parties and leverages the positive role of the countries concerned.

China supports the continued leading role of the United Nations in promoting a Libyan-led and Libyan- owned political process. We call on all parties to the Libyan conflict to achieve a lasting ceasefire as soon as possible. We appreciate the constructive actions taken recently by the international community to ease the situation in Libya. The recently held Berlin Conference on Libya issued a communiqué that reflects the important consensus reached by the participants. The Security Council’s endorsement of the communiqué will contribute to an early peaceful settlement of the Libyan question.

  46. Nevertheless, it is China’s consistent belief that sanctions are not an end but a means, and they should always serve the political settlement of relevant issues. When the Security Council takes action on the extension of the Libyan sanctions regime, it must base its decision on full consultations, and should send positive messages to the international community and interested countries that a given extension is conducive to a political settlement of the Libyan issue. The international community should respect Libya’s sovereignty, independence and territorial integrity, and support the advancement of the United Nations-brokered Libyan- led and -owned political process. Given the current grave situation in Libya, the international community must continue its strict implementation of the arms embargo and refrain from military intervention or other actions that might aggravate the conflict. China therefore voted in favour of resolution 2509 (2020), just adopted.

The current situation in Darfur remains largely stable, and the region is in a critical period of transition from peacekeeping to peacebuilding. China applauds the efforts of the Government of the Sudan in maintaining peace and stability in the Darfur region and in promoting the political process.
