Among its main hostile acts that have been internationally condemned is its feverish settlement campaign in occupied Arab lands, including its seizure of land, the destruction of houses and expulsion of its inhabitants and the settling of herds of foreign colonialist settlers in those houses - to say nothing of its construction of the racist separation barrier and the Judaization of occupied Jerusalem. All of his is happening right under the noses of the very people who call for the protection of human rights while closing their eyes to flagrant Israeli violations of human rights in the occupied Arab territories.

In the many decades of the Israeli occupation that began in June 1967, the Security Council, the General Assembly and other United Nations bodies have adopted hundreds of resolutions calling upon Israel to end its occupation of Arab territories and its massacres of unarmed and unprotected Palestinian people. Sadly, in spite of all those resolutions, the facts show that Israel continues to engage in organized and systematic practices and is not subject to international accountability for its violations of the basic principles of international law and international humanitarian law. This demonstrates that Israel is defying international law.

Mr. Ja'afari (Syrian Arab Republic) (spoke in Arabic): At the outset, allow me to say that my country is an important party to the Arab-Israeli conflict, as well as to reiterate two vital points. First, the Syrian Golan Heights have remained under Israeli occupation since 1967. Secondly, when my country was a non-permanent member of the Security Council from 2001 to 2003, we proposed that the Council convene an open public meeting every three months to consider the situation in the Middle East. My delegation would like to thank the Columbian presidency of the Council for convening this open debate to discuss the escalation of Israeli aggression against the occupied Arab territories. We had hoped to see the Secretary-General and the Council implement their minimum prerogatives regarding resolution 497 (1981) by discussing this provocative Israeli behaviour and taking measures demonstrating their rejection of this serious Israeli action regarding the occupied Syrian Golan. We have made a very detailed presentation to the Security Council regarding this serious violation of international law and legitimacy.   7. It represents a flagrant disregard for international law and the position and will of the entire international community regarding the occupied Syrian Golan and East Jerusalem. Israel must implement resolutions 242 (1967) and 338 (1973), the principle of land for peace and the Arab Peace Initiative. We assert here that this recent Israeli initiative and all others stand totally rejected and do not alter the fact that the Golan is an occupied Syrian territory. It cannot be the subject of negotiations. The return of the Golan in its entirety to the 4 June 1967 border constitutes the basis for peace. Once again, we reiterate that Israel should not consider Syria's demands to be painful concessions. These are lands and rights that have been usurped and that must be returned and restored.

  8. The Israeli occupation of the Syrian Golan is a part of this bleak picture. Israel still refuses to return the occupied Syrian Golan to its motherland, Syria. It still refuses to accept international resolutions, particularly resolution 497 (1981), which considers the annexation of the Syrian Golan to be null and void. Israel continues to terrorize citizens there. In provocation, escalation and defiance of the will of the international community, the Knesset recently adopted a law to organize a general referendum before any withdrawal from the occupied Syrian Golan and occupied East Jerusalem. This is the way in which Israel deals with issues that are not in its purview to address.

  9. Israel did not stop there. Its response to international appeals to lift the blockade was the attack on the freedom flotilla, which was on its way to Gaza on a purely humanitarian mission. Nine peace activists were killed in international waters and dozens wounded. We recall that the General Assembly recently adopted two resolutions supporting the calls of the Human Rights Commission to the United Nations, the entire United Nations system, including the Security Council, to implement the proposals in the Goldstone report. The Security Council must therefore bear its responsibilities. It must prosecute the Israeli perpetrators and punish them for the crimes they have committed in Gaza if it wishes to establish justice and to prevent impunity, two objectives of the Organization itself.

  10. There is not a single place built in this country that did not have a former Arab population." Today's meeting coincides with the second anniversary of the Israeli aggression against Gaza, which cost the lives of over 1,000 people and left thousands of innocent civilians wounded. This was very clearly noted in the Goldstone report (A/HRC/12/48), which unambiguously stated that Israel deliberately targeted civilians. The report described Israeli practices during this attack as war crimes and serious violations of international humanitarian law, which could be deemed crimes against humanity. The perpetrators of these crimes remain unpunished. This encourages Israel to continue its unfair and inhumane blockade against the population of Gaza, defying the will of the international community, which has called for the lifting of the blockade.

This extremely serious situation jeopardizes peace and security in the region, while the Security Council is unable to honour its obligations and commitments or to maintain international peace and security in accordance with the principles and purposes of the Charter. The situation reveals Israel's methodical attempt to violate rights that runs counter to the basic tenets of international and international humanitarian law. Israel's aggressive behaviour and unrestrained settlement efforts in occupied Arab territories are condemned by the international community and violate such international principles and agreements as the Charter of the United Nations and the Fourth Geneva Convention of 1949.   18. Israel's aggressive behaviour means that this country is able to achieve what no other country or usurper in history has ever achieved. This aggressive behaviour violates the legal legacy and heritage of all humankind, straightforwardly without exception, and enjoys, despite all that, some sort of protection. The occupation of the Syrian Golan is similar to the picture that I have just drawn. Israel refuses to restore the occupied Syrian Golan to its motherland, Syria, and refuses to accept international resolutions, including resolution 497 (1981). In this context, we call upon the international community, in particular the General Assembly and the Security Council, to shoulder their responsibility to prevent Israel from continuing its violations, such as pillaging natural resources in occupied Arab lands, including the Golan.

Amid its aggression in international waters against the Turkish freedom flotilla - which was bringing humanitarian assistance to the people of Gaza, besieged for four years - the bombing of the United Nations headquarters and the death of civilians sheltered there, today Israel openly states its rejection of all humanitarian principles of international humanitarian law and conducts its feverish quest to try to reverse humanitarian and legal advances by talking of the need for Judaism in that racist State so as to be able to continue its purging, racist policies of collective punishment, which, moreover, are punishable by law. Among the extraordinary paradoxes that have confronted the international community for decades, since the development of the concepts of international law and international humanitarian law, the suffering of civilians in armed conflict continues, despite the increased frequency of Security Council meetings devoted to such issues.   25. During his visit to Damascus on 13 December 2007, the Secretary General of INTERPOL declared that "Syria is a pioneer in the fight against terrorism". He also said that "the INTERPOL office in Damascus is one of the 10 best in the world". Given that there are 186 such offices throughout the world, this demonstrates Syria's serious and practical approach to fighting terrorism internationally. With respect to resolution 1267 (1999) concerning Al-Qaida and the Taliban, we are taking every measure stipulated therein. With respect to resolution 1373 (2001), Syria periodically presents national reports in the framework of international efforts. With respect to resolution 1540 (2004), in 1968 Syria was one of the first signatories to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT).

The report of the FATF mutual evaluation team highlighted Syria's efforts to that end: "The Government of the Syrian Arab Republic has in recent years succeeded in adopting practical measures and important legislation to that end, in conformity with relevant international recommendations". Convinced of the central role of the United Nations in fighting terrorism at the international level, Syria cooperates fully with the three Committees established pursuant to resolutions 1267 (1999), 1373 (2001) and 1540 (2004). We have created national commissions to ensure the optimum implementation of those resolutions and to promote cooperation with the Committees of the Security Council established to ensure their implementation.   29. We did so on condition that Syria's concerns be taken into account with respect to the definition of terrorism and the distinction between State terrorism and resistance. State terrorism is very serious, perhaps the gravest kind of terrorism. The greatest example of it are the daily crimes committed by Israel against the Palestinian people since their occupation of the Arab territories. Perhaps the most abject example of this were the killings that took place during the aggression against Gaza and the freedom flotilla, which was attacked in international waters as it sought to deliver humanitarian assistance to the people of blockaded Gaza, not to mention the assassination of national Palestinian personalities in other countries.

  30. In that regard, Syria reaffirms its compliance with relevant international resolutions concerning the fight against terrorism. We are convinced that the General Assembly plays a central role in the counter-terrorism struggle at the international level, as well as in establishing international consensus. We believe that the Security Council Committees responsible for fighting terrorism can also play a role in coordinating international counter-terrorism efforts through transparent and neutral mechanisms. We joined the consensus during the adoption of the United Nations Global Counter-Terrorism Strategy in 2006 based on our support for all international efforts to that end and because we are convinced that the Strategy is an important tool for facilitating international cooperation in the fight against terrorism.

Syria has advocated against linking terrorism with any particular religion, ethnicity, nationality or civilization, and has also called for a definition of terrorism under the aegis of the United Nations. We have called for analyzing this phenomenon in all its aspects and for discussing the conditions that lead to its spread. The Syrian Arab Republic reaffirms the need to distinguish between terrorism and the legitimate right of peoples to resist foreign occupation. We believe that force alone is inadequate in fighting terrorism. It is essential to look at the underlying causes, considering that all of the measures used to counter terrorism must be taken in the framework of international legitimacy and in conformity with countries' obligations stemming from the United Nations Charter and international law.

Israeli State terror has targeted United Nations Members and peace activists, including the ship Rachel Corrie and Turkish victims. It also included the first air piracy case in history when Israel hijacked a Syrian civilian aircraft in 1954. I repeat that Israel hijacked a plane in 1954 and shot down a civilian Libyan jet in 1971. Recently, as representatives well know, Israel forged passports of some of its allies to assassinate Mahmoud Al-Mabhouh, a Palestinian citizen in Dubai. The list goes on. We recall what has recently been disclosed by classified Israeli documents concerning the 1973 war. These documents show that, by the second day of the 1973 war, Israel had prepared a nuclear bomb, with which it planned to attack the city of Damascus.

  39. As President Bashar Al-Assad has said, it is clear that the Israeli Government is not concerned about peace. Its main concern has been security in a very narrow sense - their settler, expansionist and hostile security, which in their view can be achieved only at the expense of our rights and our security. It is illogical and not even acceptable that we Arabs have to continue to provide proof and evidence that we are seriously interested in peace, despite our repeated declarations and statements to that end on various occasions, in particular since the convening of the 1991 Madrid Conference. The Israelis must prove that. The Israelis must express in deeds, not only in words, that they are ready for a just and comprehensive peace.

  40. It pursues a policy of terror and oppression of the Syrian people of the Golan. It detains Syrian citizens of the Golan and continues to confiscate land in order to plant mines and expand settlements. We recall that Israeli mines in the occupied Syrian Golan injured 531 people, of whom 202, for the most part children, died and 329 were permanently disabled. Israel continues to steal the water of the Golan. A few days ago, it drew water from the al-Ram dam in the occupied Syrian Golan, which led to a total loss of the reservoir's water and to the death of all fish there. Here, we stress that Syria's sovereign right to the occupied Syrian Golan to the line of4 June 1967 is not subject to negotiation. Our full recovery of the Golan is the basis on which any steps to build peace should be founded.

  41. How can we explain to the world the fact that the Security Council has chosen to remain silent vis-a-vis these crimes? Today more than ever before, the Council is called on to undertake practical and concrete measures, commensurate with Israel's 10-59122 flagrant behaviour, to compel Israel to end its occupation of Arab territories. The international community must also strive to lift the deeply unjust siege of the Palestinian people of Gaza, open all the checkpoints, and reconstruct Gaza while providing international guarantees to prevent Israel from again destroying facilities and infrastructure there. Israel continues to refuse to return the occupied Golan to its motherland, Syria, and to comply with the decisions of international legitimacy, particularly resolution 497 (1981).

Moreover, Israel pursues its policy of collective punishment, the detention of thousands of Palestinian civilians and officials, and the abuse of detainees, including women, by Israeli soldiers. The most recent of these racist Israeli decisions, adopted only a few days ago, concerns the requirement of non-Jews to pledge allegiance to the Jewish State. It is yet another expression of Israeli fascism, manifest in killings and racist laws that contradict twenty-first century calls for freedom and equality. They also contradict Israel's claim to be an oasis of democracy in the Middle East. The Palestinian people still await international justice and expect us to come to their rescue. The question we must ask ourselves, however, is how long Israel will remain an entity above the law and accountable to none.

It committed yet another act of aggression against Lebanon in the summer of 2006, followed by its aggression against Gaza in 2008, which killed thousands of Palestinian civilians and injured many, many more. Israel's crimes include the murder of humanitarian activists of various nationalities who tried to deliver humanitarian assistance to Gaza on the freedom flotilla. Not satisfied with all this, Israel has continued to pursue settlement policies, build the racist separation wall, violate and desecrate holy shrines, lay siege to the defenceless Palestinian people of Gaza, and endorse decisions to Judaize the city of Jerusalem, the most recent of which was the decision to renovate certain parts of the old town.

Syria and the Arab States have sought peace through the adoption of the Arab Peace Initiative, including the full restoration of usurped Arab rights, Israel's complete withdrawal from all occupied Arab territories to the line of 4 June 1967, the establishment of a Palestinian State with Jerusalem as its capital, and the settlement of the question of Palestinian refugees in accordance with the resolutions of international legitimacy. However, Israel's answer to the Arab Peace Initiative has been its invasion of the West Bank, its 2002 massacres of Jenin and Nablus, its policy of continued expansion and settlement, and its appropriation of land and usurpation of natural resources and capabilities. Israel has not stopped at these cumulative, provocative excesses.

Israel claims these days to be negotiating peace on the basis of the two- State solution, yet its settlement activities are on the verge of making that solution dead letter and without a chance of survival. Peace is only as viable as the desire to make peace is translated into practical deeds. Political manoeuvring behind the smokescreen of paying mere lip service to peace only exacerbates an already tense situation and pushes it towards the precipice. We would stress once again that Syria's demands for peace are not the type of compromises that Israel claims to be making courageously and publicizing as painful. We are talking about usurped lands and rights that must be restored in full to their legitimate owners.

While the entire world seeks to establish a just and comprehensive peace in the Middle East and insists that the achievement of peace is an urgent prerequisite for the maintenance of international and regional peace and security, it is astonished by Israel's continued beating of the drums of war, appropriation of land, ongoing settlement activity, blockade of Gaza and threats to again expel millions of Palestinians from their homeland under the racist pretext of affirming the Jewish identity of the State of Israel - an outdated policy whose consequences are known to all. These practices in no way indicate Israel's real intentions or a desire for peace on its part. Israel has already made its rejection of peace clear by refusing even to accept the modest request to extend the moratorium on settlement activity.

We also thank the Permanent Representative of Turkey and the members of his delegation for their efforts last month. I further thank Assistant Secretary-General Fernandez-Taranco for his briefing to the Council this morning. This open debate has been convened in circumstances that do not augur well for the Middle East, given Israel's feverish efforts to obliterate our last hopes to achieve a just, comprehensive and lasting peace in the region through its unprecedented aggressive policies in the Arab territories occupied since 1967.

The problem with Israel's representative here and its policymakers and decision-makers is that they have not yet understood that occupation is one of the worst crimes of aggression, as defined in General Assembly resolution 3314 (XXIX). They have not yet grasped that they have exhausted this Organization after hours - years - of meetings on how to bring their occupation of our land to an end. One solution could be for the United Nations Institute for Training and Research (UNITAR) to organize a conference or special training session for the representative of Israel and Israeli decision-makers to help them understand the definition of aggression as stipulated in the Charter and in United Nations resolutions.

She is also oblivious to the fact that Israel uses that military arsenal to perpetuate its occupation of our land, to continue committing its acts of aggression and to commit acts of piracy against the activists of the peace flotilla. Indeed, Israel deploys submarines capable of carrying weapons to the Red Sea and the Arabian Sea, and issues threats of war every day. It violates international law, international humanitarian law and the Charter of the United Nations all at once on a daily basis. Israel is known to be one of the largest importers of weapons in the world. It is also the world's fourth largest weapons exporter.
