Israel was not satisfied by having occupied the Syrian Golan since 1967 but enacted an unjust and provocative decree to annex it.

  2. In the same context, Israel persists in its policy of disrupting all forms of communication among Syrian families that have been torn asunder as a result of occupation. Also, the Israeli occupation authorities confiscated the Syrian identity cards of Syrian students studying at Damascus University when they returned to their towns and villages in the occupied Golan. To lend credibility to this special debate, Syria demands that this Council bring pressure to bear on Israel in order to allow the immediate resumption of family visits by Syrian citizens through the Quneitra crossing.

Israel also persists in oppressing the Syrian civilian population in the occupied Golan and throwing civilians into prisons and detention centres, without justification, in life-threatening conditions. Let me also cite in particular the case of a Syrian citizen, Bishr al-Mukt, with respect to whom my Government has appealed to the Secretary-General and to the International Committee of the Red Cross and other international institutions, urging them to intervene to save his life. The most recent such practice in the occupied Syrian Golan was the imposition by the Israeli authorities of two years of house arrest against a two-year-old child, Fahid Lu'ay Shuqeir, on the excuse that he was born outside Israel when his parents were studying in Syria.

  4. Here we ask the Security Council to tell us: What international obligations has Israel met since the Council added this item to its agenda? Another important question to which an answer would be much appreciated is this: Why do we have a double standard for the implementation of international law, with Israel exempt from fulfilling the norms of international law? Or is there a crisis in the understanding of legal terminology, by which Palestinian civilians are considered to be unlike any other civilians in the free world? The situation of Syrian civilians in the occupied Syrian Golan does not differ greatly from that of the Palestinians. The Israeli occupation authorities continue to pursue practices such as confiscating land, stealing water resources, laying mines and expanding illegal settlements.

  5. My delegation carefully studied the Secretary- General's summary of the report of the Board of Inquiry he dispatched to Gaza. That report documents crimes committed by Israel against United Nations premises and against Palestinian civilians in those premises, including women and children. It documents Israel's use of white phosphorus bombs and its responsibility for deaths and injuries within United Nations buildings, along with the damage caused to those premises. Those are all war crimes, and the Security Council is obliged, more than ever before, to implement the recommendations of the Board of Inquiry, which was chaired by Mr. Ian Martin, and to hold Israeli leaders accountable for their repeated crimes, which are legally defined as war crimes, crimes against humanity and genocide.

Furthermore, in his most recent report, the Secretary-General stated grave concern at the high number of casualties in Gaza, in particular among children, and at the damage to homes and schools, including schools operated by the United Nations itself, as a result of the Israeli aggression. The Secretary-General also expressed concern at Israel's wide-scale use of cluster munitions and explosive weapons against civilian populations in Gaza. In his report, the Secretary-General states that Israel has persisted in imposing restrictions on the delivery of humanitarian assistance to Gaza and noted the broad impact on the lives of civilians. The report states that "[t]he cumulative effect of these restrictions and their unpredictability contribute to the protracted suffering of Gaza's civilian population" (S/2009/277, annex, para. 16).

The Council has also stressed that parties to armed conflict bear the primary responsibility to take all feasible steps to ensure the protection of affected civilians and to meet their basic needs, including by giving special attention to the specific needs of women and children. Israel's criminal acts are a unique instance of the systematic and comprehensive breach of all international norms and principles set forth in international law, international humanitarian law, international human rights law, the Rome Statute of the International Criminal Court and the 1949 Geneva Conventions and their Protocols. Israel's aggressive behaviour is marked by a stain that no other usurper of land in history has borne: it breaches, en masse and without exception, the entire cumulative historical body of human law. In a series of statements, most recently that of 14 January 2009 (S/PRST/2009/1), on the protection of civilians in armed conflict, the Security Council has condemned all violations of international law against civilians and has called on all parties concerned to put an end forthwith to such practices.

To this day, Israel continues its policies of aggression against the Palestinian civilian population by imposing a siege, closing border crossings, carrying out detentions, forbidding movements by sick people and students, impeding the delivery of international aid in the form of supplies and medicine to the people of Gaza, imposing collective punishment, confiscating land, engaging in settlement activities, demolishing homes and burning farmland, in addition to its oppressive and arbitrary practices against the civilian Syrian population of the occupied Syrian Golan. At that time, most delegations demanded that Israel, the occupying Power, comply with international law and norms relating to the protection of Palestinian civilians in Gaza; they stressed the need to ensure the delivery of humanitarian assistance to those people and the need for an independent international investigation of the war crimes committed by Israel during that aggression. The world has seen remarkable progress in the legal field and through international agreements in addressing the issue of the protection of civilians in armed conflict, beginning with the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War and the many subsequent resolutions adopted by the Council. However, the striking paradox here is that the gap is widening between the texts and their application on the grounds, in other words between what is legal and the practices on the ground regarding the protection of civilians in armed conflict. The millions of Palestinian refugees in neighbouring countries and throughout the world have the right of return to their homeland, in accordance with General Assembly resolution 194 (III) of 1948. My country and the overwhelming majority of Members of this international Organization support the right of those Palestinian refugees to return to their homeland. My country insists on the full implementation of the rules of international law and the relevant United Nations resolutions. The world has witnessed the extent of Israeli State terrorism against the Palestinian population in Gaza, against the Lebanese and against the Syrian residents of the occupied Syrian Golan. The United Nations has adopted hundreds of resolutions that condemn Israeli occupation and call for an end to it.

As the Council is well aware, the main objective of that effort is to distract attention from the terrorism carried out by the State of Israel in occupied Palestinian territories, occupied Syrian Golan and the remaining occupied Lebanese territories. In a historic resolution, the United Nations has acknowledged that foreign occupation is the worst form of aggression. Moreover, the Charter guarantees the right of peoples to freedom and liberation from occupation and colonization. Thus, the representative of Israel's insistence that Palestinian refugees - who have been expelled from their homeland by Israeli terrorism and dispersed in neighbouring territories and throughout the world - should be considered to be terrorists is a futile attempt to push the clock back and to restore a colonialist mentality to international relations.

The Syrian commission to counter money-laundering and the financing of terrorism has joined the Egmont Group, which unites financial intelligence units from 108 States and is responsible for receiving and handling reports on financial operations suspected of laundering money or financing terrorism. Those efforts are internationally recognized in the report of a joint assessment group, which notes that Syria has implemented significant measures and legislation in 09-34980 recent years, in accordance with relevant international recommendations. In conclusion, Syria is closely following the Committee's efforts to follow-up the implementation of resolution 1540 (2004), which my country sees as a positive step towards preventing the proliferation of weapons of mass destruction and for maintaining international peace and security.

My country believes that the Security Council's counter-terrorism Committees contribute to coordinating the international effort against terrorism, despite the observations and reservations regarding some of their decisions that we have voiced on numerous occasions. The international consensus at the United Nations, both in New York and Geneva, which called for the creation of a fact-finding committee of the Human Rights Council and an investigative commission by decision of the Secretary-General, reflected the international moral and political consensus regarding Israel's responsibility for the terrorist crimes carried out against the population of Gaza. Not satisfied with that, Israel followed up by killing the besieged population of Gaza through a barbaric and cruel aggression using the most modern weapons and internationally banned munitions. If such outlaw practices are not terrorism, then what exactly is terrorism? Israeli terrorism has touched everyone without exception. The murder and destruction pay no heed to the humanity of the Palestinian citizen residing in his own home, the employees of the United Nations, or those seeking refuge in United Nations buildings and facilities. Accordingly, Syria has called since the mid-1980s for an international conference under United Nations sponsorship in order to agree upon a specific definition of terrorism, formulate an effective international strategy to combat terrorism and distinguish it from the legitimate struggle of people under occupation to achieve their freedom, which by right is guaranteed by international norms and laws. Syria reaffirms its condemnation of terrorism as aggressive and unjust criminal activity that targets the lives and property of innocent civilians, and we call for action at all levels to combat international terrorism in accordance with the principles and purposes of the Charter of the United Nations and the provisions of international law. Representatives from Israeli parties in the settlement of Qatzrin, which was built on the ruins of the Syrian village of Kasreen, signed a joint cooperation agreement to coordinate their efforts to oppose any Israeli withdrawal from the Golan. The Israeli army has also recently carried out massive military exercises in the occupied Golan, employing all sorts of land, naval and air weaponry. I would like to remind the Council that the number of victims of Israeli landmines in the occupied Syrian Golan stands at 531, including 202 fatalities, most of whom were children. That is in addition to the 329 injured persons with permanent multiple disabilities. Israel continues to refuse to allow the resumption of family visits by Syrian citizens in the occupied Golan through the Quneitra crossing point.

In that regard, we appeal to the United Nations and the Security Council to pressure Israel to release Syrian captives, including journalist Atta Farhat, who was arrested by Israel because of his nationalist journalistic work, given a show trial and sentenced to three years in prison. Israeli occupying authorities continue to expropriate land and to expand their illegitimate and illegal settlements in the Syrian Golan.   32. Syria reaffirms the need to restore Palestinian national unity through a national dialogue so as to strengthen the Palestinian negotiating position and the resolve of its people. As Chair of the Arab summit, Syria is striving to achieve that unity. Israel continues to refuse to return occupied Golan to Syria, and to abide by legitimate international resolutions, especially resolution 497 (1981). Israeli actions in the occupied Syrian Golan have exceeded every legal and moral boundary. It has pursued its policy of terrorizing and suppressing Syrian citizens of the Golan, arresting them and placing them in detention centres in conditions that jeopardize their lives. Syria reaffirms its steadfast and continuous support for the rights of the Palestinian people to regain their occupied land and establish their own independent State, with Jerusalem as its capital. We also reiterate the need for an immediate end to the oppressive blockade against the Palestinian people in Gaza, for the reopening of all crossings, for the reconstruction of Gaza and for international guarantees to prevent Israel from demolishing again the facilities and infrastructure that are to be rebuilt. In parallel, Israel continues its settlement activities in the occupied Arab territories and the construction of the racist separation wall in blatant violation of the advisory opinion of the International Court of Justice. Today is also the sixth anniversary of the assassination of American peace activist Rachel Corrie, who was run over by an Israeli bulldozer because she opposed the demolition of Palestinian homes to build the separation wall. Most of the world's countries and every United Nations body have adopted clear positions condemning Israeli settlement activities, which impede the establishment of peace, are in contradiction to the pledges made at Annapolis, constitute a genuine obstacle to peace and lead to an escalation of tensions in the region.

  35. They are deceiving themselves when they think in such a manner. An even more repugnant and surreal manifestation of the conduct of the Israeli occupation authorities is the fact that these authorities impose a fine of $20,000 on any Palestinian whose home these authorities demolish. Their justification is that this money is to cover the expenses of the demolition. What does the Council think of that? Israel is thus asking the Palestinians to pay the price of the bullets it will use to shoot them. How surreal, how sadistic this is. It is also strange that the Israeli Government has issued a decision preventing any Palestinian cultural activity in Jerusalem, which by an Arab decision was declared the Arab cultural capital.

  36. What Israel is doing to Palestinians is the true holocaust. Despite Israel's desperate attempts to justify its aggression against Gaza, what it is doing now in the West Bank and Jerusalem reveals its true intentions towards the Palestinian people. Israel is not content with its racist policies and its practices of coercion. It has escalated its brutal attacks against the residents of Jerusalem who live close to the Al-Aqsa mosque, demolishing their homes and displacing them in an attempt to breach the sanctity and diminish the significance of the Al-Aqsa mosque and to Judaize the city of Jerusalem. Israel's decision to demolish 88 homes in the village of Silwan near the Al-Aqsa mosque and its continued excavations under the mosque are nothing but an attempt to carry out a preconceived plan to take control of the mosque and demolish it.

The continued occupation of Arab land in Palestine, the intensified settlement and colonization activities in the Syrian Golan and in Palestine and 09-28062 Israel's persistence in occupying Lebanese territories and in refusing to abide by legitimate international resolutions in order to achieve a just and comprehensive peace in the Middle East have all led to an escalation of tensions, an absence of stability and security in the region and a situation that is deteriorating in all its aspects. The international community, in particular the Security Council, is called upon to hold Israel's leaders accountable for their repeated crimes, which are legally defined as war crimes, crimes against humanity and crimes of genocide.

We must not overlook the article that The Guardian published setting out the first-hand testimony of Israeli soldiers and officers who participated in the aggression against Gaza, soldiers and officers who targeted Palestinian ambulances and medical relief workers, and who killed 47 among them. Nor must we overlook the testimony of Ms. Radhika Coomaraswamy, Special Representative of the Secretary-General for Children and Armed Conflict. She spoke of a young Palestinian boy, not even 12 years old, who was used by the Israeli army in Gaza as a human shield.

  40. This entailed war crimes and crimes against humanity, which, as the Council knows, outraged international public opinion. International opinion now demands with unprecedented insistence that the Israeli perpetrators of these crimes be put on trial. Recently, 16 prominent international personalities, including senior judges and human rights advocates, such as Archbishop Desmond Tutu, Ms. Mary Robinson and Justice Richard Goldstone, sent a letter to the Secretary- General in which they called for an immediate, independent international inquiry into Israel's violations of international law during its recent aggression against the Palestinian people in Gaza. Richard Falk, the United Nations Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967, described this aggression as a war crime.

Meanwhile, instead of reaching out to the Arab hand outstretched in peace, Israel responded by attacking the West Bank and carrying out the J enin and Nablus massacres, enforcing a blockade on the defenceless Palestinian people, and by specializing in killing women and children, desecrating places of worship, changing the character of Jerusalem and Judaizing it, carrying out a scorched-earth policy and collective punishment and mass arrests and building settlements and constructing the racist separation wall on occupied Palestinian lands. That is Israel's record with regard to the item now under consideration, which is the situation in the Middle East. Not satisfied with these cumulative, provocative violations, Israel carried out its brutal aggression against Lebanon in the summer of 2006 and another aggression against Gaza recently.

The United Nations in general and the Security Council in particular are therefore called upon to rise to the level of the purposes and principles of the Charter by trying to implement at least some of the hundreds of resolutions and decisions adopted in this international Organization since its inception to put an end to the Israeli occupation of Arab territories, stop its violations of human rights there and halt its practices that contravene international humanitarian law and the Fourth Geneva Convention of 1949. That is the most important thing as we discuss the agenda item on the situation in the Middle East in the Security Council. That is at the heart of the matter. We should not be sidetracked by the representative of Israel as we discuss an issue that has been before the Council for decades.

My country has dispatched messages in this regard to the Secretary-General, the Presidents of the Security Council and General Assembly and governmental and non-governmental organizations requesting them to intervene to help in resolving this 1ssue. We hope that all of these parties would translate the positions that they have taken today into real actions, especially since international law stipulates that Israel's occupation of the Golan is actually several occupations, thus requiring that the Council issue several incriminations. Israel has not been occupying the Syrian Golan since 1967, but also adopted a provocative and unjust resolution claiming to annex the occupied Golan, which was unanimously rejected by this Council in its resolution 497 (1981).

Also, representatives of Israeli parties in the settlement of Ketzarin, which was also built on the rubble of a Syrian town, Qazrin, have signed a coalition agreement within the framework of the regional settlement council that aims to establish cooperation and coordination among them in order to oppose any Israeli withdrawal from the Golan in light of the resumption of indirect negotiations to that end. Israel continues to impose a policy of oppressing civilian Syrian citizens in the occupied Syrian Golan. It continues to imprison them with no due cause and to subject them to situations that could jeopardize their lives. We would like to call attention here to the case of prisoner Bashir A1 Moqt. My Government has called on the Secretary-General, the Red Cross and others to intervene to save his life.

  49. The Israeli occupation forces continue to confiscate land and to expand illegal settlements. The so-called regional settlement council in the Golan, with the support of the occupation Government, has endorsed plans to build a new settlement tourism village that would occupy 40 dunams near the Israeli settlement of Ani'am, which was built over the ruins of the Syrian town of Nakhila Taibeh. Moreover, that council, in cooperation with the religious Yonatan settlement administration, which is an extremist organization, has set up a plan to attract thousands of settlers so that their numbers would increase to over 50,000 in the near future.

It is not permissible for some, even with good intentions, to repeat in this Chamber Israel's lie that its aggression against the Palestinians is in self- defence, in application of Article 51 of the Charter, because that Article does not apply to invading forces that forcibly occupy others' lands and have done so for decades. Quite to the contrary, Article 51 of the Charter applies by default to the Palestinians' resistance against Israeli occupation, in self-defence. In other words, the right to self-defence must not be manipulated by some to justify their silence over Israel's crimes. There is an Arabic proverb that says "Those who do not speak out against wrong are but a silent Satan". The situation of Syrian residents in the occupied Golan is not much different from that of the Palestinians.
