All of these reports mention, hundreds of times, that it is Israel that violates resolution 1701 (2006) and violates the sovereignty of Lebanon around the clock. She forgets that Israel is the most heavily armed of the parties, with conventional as well as nuclear weapons: Israel is armed to the teeth. Since 1950, certain countries have assured Israel of its military superiority over all its Arab neighbours combined.

  2. It is for the Israelis to prove that they want peace and to manifest in a pragmatic and realistic way that they are seeking peace and justice. They have to try to convince us, the Arabs, that they want peace. It is they who occupy our land. It is they who attack our people. It is they who displace millions of our people.   3. This decision is in clear defiance of the entire world and a rejection of peace. All that has been said by Israeli Government representatives is just manoeuvring and manipulation: there is no real Israeli partner for peace. The clear reality, as His Excellency President Bashar Al-Assad has said, is that peace has never been an obsession of Israel; Israel's obsession has always been its own security, in the narrowest sense. This can be realized only at our cost in terms of peace and rights. It is illogical and unacceptable that we, the Arabs, should be required to continue proving our sincere desire for peace, even though we have declared it repeatedly, especially since the Madrid Conference in 1991.

My country's Minister for Foreign Affairs, in identical letters dated 4 January 2010 addressed to the President of the Security Council and to the Secretary- General (S/2010/4, annex), referred to Israeli violations in the occupied Syrian Golan Heights, where Israel is planning to Judaize and control even more Syrian territory in the Golan, in steps that send a provocative message to Syria and other States that are seeking peace in accordance with the relevant United Nations resolutions. And, yet, in flagrant defiance of the will of the international community, the Israeli Knesset, just a few days ago, on 9 July, adopted, after a first reading, a resolution stating that any agreement on withdrawal from East Jerusalem and the Golan Heights should be subject to a referendum requiring the support of 80 per cent of Israelis.

Since that occupation, Israel has employed every possible means to attempt to expel the citizens of the area, impose colonizing settlements on them and import foreign settlers, preferring them over the indigenous people of the Golan, whom they have incarcerated in detention. Recent Israeli military exercises in the Golan Heights have destroyed 5,000 dunums of fertile land. On 12 July, Israeli forces used force to enter the home of a Syrian citizen in the village of Mejdel Shams. When villagers attempted to face them, some 25 persons, including women and children, were hurt as a result of the tear gas munitions used by the Israeli forces, and some were hit by rubber bullets. Mr. Lynn Pascoe referred to this incident today.

After 43 years of Israel's unjust occupation of the Syrian Golan Heights - and despite all the resolutions concerning its international illegitimacy, including resolution 497 (1981), and the call by a majority of the countries of the world to put an end to that occupation, as well as their condemnation of Israel's oppressive practices and violation of so many laws and resolutions - Israel still refuses to accept these appeals or to implement any resolutions. On the contrary, after occupying the Syrian Golan, Israel declared its annexation, in clear violation of the principles of international law and its obligations under the Geneva Conventions of 1949.

  7. Thus, we call today on the Security Council to shoulder its responsibility to hold Israel's officials responsible for their acts and to punish them for their crimes in Gaza. I would like to note here that Mr. John Ging, the Director of Operations in Gaza of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), stated today that all Israeli claims to have reduced the effects of the blockade and allowed the entry of some basic goods into Gaza are totally incorrect. We also recall that the General Assembly has approved the recommendations of the Goldstone report (A/HRC/ 12/48), which included conclusive evidence concerning Israel's violations of the Universal Declaration of Human Rights and international humanitarian law during its aggression against Gaza. Such violations are tantamount to war crimes and perhaps even to crimes against humanity. Every United Nations body has called for the implementation of the report's recommendations.

Israel defies not only international law, but its own bilateral relations with important countries within and outside the region, in a manner that threatens the region's stability and embarrasses its closest allies. Around two months ago, this Council adopted a presidential statement (S/PRST/2010/9) in which it called for a prompt, impartial, credible and transparent investigation conforming to international standards; for the immediate release of the convoy ships; and for the delivery of their humanitarian assistance to besieged Gaza. Today more than ever, the Security Council must move beyond the mere condemnation of such acts; it should translate its resolutions into practical steps commensurate with Israel's terrible actions, so that they do not meet the fate of other, previous resolutions on Israel that remain dead letters.

  10. The Israelis' rejection of this is clear; they disdain all such decisions. Committing crimes against the Palestinian people is not enough; their crimes have extended to peace activists of other nationalities who tried to deliver humanitarian assistance to Gaza on the freedom flotilla. Israel's terrorist aggression killed nine civilians whose only crime was to try to help the people under blockade and whose suffering could not be alleviated by all the resolutions and decisions adopted by the international community. That was Israel's true response to the proposals for peace in the Middle East, a response that we have 10-45934 sought to remind the world of throughout the decades since Israel first occupied our lands.

  11. Such settlements have devoured around 42 per cent of the lands of the West Bank, according to reports by the Israeli organization B'Tselem, in clear violation of international law. We should recall that Israel continued to pursue these policies until a few days ago. After the meeting between President Obama and Israeli Prime Minister Netanyahu, Israel announced the construction of 32 new settlement units in East Jerusalem. Syria, along with other Arab countries, has worked, through the adoption of the 2002 Arab Peace Initiative, to achieve peace and all that peace entails: the restoration of all Arab rights, including Israel's total withdrawal from all occupied territories to the line of 4 June 1967, and the settlement of Palestinian refugees as set forth in General Assembly resolution 194 (III) of 1948.

Israel continues to work for the Judaization of Jerusalem, to build a racist separation wall on occupied Palestinian territory, to intensify settlement activity there, to occupy the Syrian Golan and to blockade Gaza. It has attacked the freedom flotilla ships and murdered the international peace activists they carried, in flagrant defiance of the international community and in violation of international law and the basic values and principles of humanity and civilization. This meeting is being held in the sixth year since the International Court of Justice adopted its advisory opinion confirming the illegitimacy of the separation wall, and long decades since Israel first occupied Arab territory. That is indeed the crux and the fundamental reason for the Arab-Israeli conflict.

For example, house arrest was imposed for years against Fahd Shokir, a two-year-old child, under the pretext that he had been born outside Israeli territory while his parents were studying in Syria. In order to give credibility to this debate, Syria calls upon the Council to compel Israel to allow without delay the resumption of visits by Syrian citizens to residents of the occupied Syrian Golan through the Quneitra crossing. We have addressed messages in that regard to the Secretary-General, the President of the Security Council, the President of the General Assembly and the relevant international Governmental and non-governmental organizations.   17. The same war crimes committed by Israel against Palestinians have also been committed against the Syrian people of the occupied Golan Heights. They are therefore dual crimes, and the Council should deal with them appropriately. We say they are dual because, as we all know, Israel annexed the occupied Syrian Golan Heights and Jerusalem despite the existence of two Council resolutions condemning that annexation and requesting Israel to abolish all legislation imposed on the two occupied territories. Israel is continuing its oppression of the civilian Syrian population of the occupied Syrian Golan, detaining them in prisons without any legal grounds and in violation of all legal and moral principles. In essence, they have been placed under house arrest.

The United Nations Fact- Finding Mission on the Gaza Conflict, headed by Justice Richard Goldstone, has in its two reports provided compelling evidence of Israel's violation of the Universal Declaration of Human Rights and international humanitarian law during its aggression on Gaza. As described by Justice Goldstone himself, those violations could be considered as war crimes and crimes against humanity. We wonder about the Council's response to all the facts contained in an international report accepted by the Human Rights Council and the relevant United Nations agencies, as well as about its response to the hundreds of reports and conclusions by other international fact-finding commissions and Special Rapporteurs, such as Richard Falk, Jean Ziegler and John Dugard, among others.

  19. Israel's actions have even affected humanitarian activists of various nationalities from the freedom flotilla, who attempted to provide assistance to the people of Gaza. Israel confronted the flotilla with acts of aggression that led to the death of nine civilians, who were only guilty of trying to provide medical and humanitarian assistance to people subjected to a blockade. All the requests, resolutions and international calls have failed to alleviate their suffering. We do not know how much longer we can turn a blind eye to Israel's inhuman actions, which constitute a unique case of systematic wholesale violation of every principle, norm and law enshrined in international agreements.

To date, the United Nations as a whole, including the Council, has failed to ensure the entry of basic materials necessary to rebuild UNRWA schools destroyed by Israel, in spite of the fact that resolution 1894 (2009) urged the parties to take all necessary measures to respect the rights of civilians, protect them and provide for their basic needs. In addition to continuing to refuse to comply with that and previous resolutions, Israel is also continuing its aggressive policies against Palestinian civilians. Those include the blockade, the closing of crossing points, detentions, denial of the freedom of movement, refusing to allow students to receive medical treatment and obstacles to the flow of international assistance, not to mention the deplorable conditions of civilians in the West Bank and the Golan Heights.

The Security Council adopted resolution 1894 (2009) on the occasion of the tenth anniversary of the Council's consideration of the issue of the protection of civilians in armed conflict, and two years after the Israeli aggression against the Gaza Strip and its civilian population. Were those civilians launching rockets against Israel as they sought refuge in the United Nations compound? Or were United Nations forces in Qana and Gaza using those civilians as human shields? The same questions could be asked with regard to Palestinian civilians who were killed by attacking Israeli forces in Gaza during the aggression of 2008 and 2009 as they sought shelter in the schools of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) in the Gaza Strip.

  23. I would like here to raise some of the same questions that many other Member States have asked. Are not the 12,000 prisoners held in Israeli jails civilians? Are not the Syrian inhabitants of the occupied Golan Heights civilians? Are not the more than 500 killed and injured as a result of Israeli mines planted in the occupied Golan Heights civilians? Do they not deserve protection? Are not those who daily face the most severe violations of their rights in the occupied Arab territories civilians? Are not the children, women and older persons who are deprived of more than 7,000 basic commodities, including chocolate, mayonnaise and other necessities, civilians? And not the people of occupied Jerusalem, whom the Israeli occupying authorities are daily expelling from their houses and their occupied city, civilians?

Despite those developments, we continue to see situations on the ground that uphold double standards - often in defence of the violation of international humanitarian law instead of protecting it. In fact, the gap between the letter of the law and its application on the ground is increasingly widening. We are concerned by the fact that some statements by representatives of Member States in connection with deliberations on the protection of civilians in conflict situations at times display a selective understanding of the issue that is contrary to the provisions of international humanitarian law. We are also concerned by the fact that some seek to transform the suffering of civilians in certain areas of armed conflict merely into a contentious academic debate. That does not help to alleviate the suffering of civilians.

Before I continue with my statement, I would like to thank Under-Secretary-General Sir John Holmes of the Office for the Coordination of Humanitarian Affairs for his efforts to implement international humanitarian law at a time when serious crises hampered that goal in various regions of the world. The awakening of the human conscience in sympathy for civilian suffering resulted in legal developments that led to the establishment of the United Nations and various international instruments aimed at stopping and preventing war, ending foreign occupation and promoting the use of law to resolve international disputes and address the protection of civilians in armed conflict. First among those was the Geneva Convention relative to the Protection of Civilian Persons in Time of War, followed by a number of Security Council resolutions.

As is well known, since then Israel has been the only party in the Middle East in possession of a colossal arsenal of nuclear weapons; it is the only party in the region that refuses to accede to the NPT or to permit any IAEA supervision of its installations. This is evident in its position on the current NPT Review Conference. There have been dangerous repercussions from Israel's failure to comply with the Treaty, which demonstrates its lack of respect for resolution 1540 (2004), for the IAEA and for all international efforts aimed at achieving nuclear disarmament. In conclusion, Syria reaffirms its ongoing call for the Middle East to be freed of nuclear weapons.

Syria has participated in numerous workshops on combating terrorism, including the Doha workshop on implementing resolution 1540 (2004) and a regional workshop held in Abu Dhabi from 28 to 30 June 2009, organized in cooperation with the United Nations Office on Drugs and Crime. Syria also participated in the workshop on national counter-terrorism focal points held in Vienna in 2009. My country has also presented a national report to the 1540 Committee on the implementation of resolution 1540 (2004). As is well known, Syria was one of the first States to sign the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) in 1968. Syria stands against the possession of nuclear weapons by any State. Moreover, we signed an IAEA Comprehensive Safeguards Agreement in 1992.

My country's efforts are acknowledged internationally in the Group's joint evaluation report, which states that Syria has managed in recent years to adopt important domestic measures and legislation on this score, alongside relevant international efforts. The relevant entities in Syria are undertaking a study on amending the 2005 law on money-laundering and financing of terrorism in line with international efforts in this respect. We would also refer to decree No. 30 of 2010, issued by President Bashar Al-Assad, on banking confidentiality, which regulates the work of financial institutions. The decree seeks to strike a balance between the banking confidentiality of financial agents and the measures necessary to combat money- laundering operations and the financing of terrorism.

  31. Yet we note the existence of a certain degree of discrimination practiced by the Committees in dealing with the Member States. For instance, we notice a concentration on certain States or geographic groups and not others. While the Committees request some States to submit reports on the implementation of terrorism-related resolutions, they fail to issue such requests to others. Syria is making strenuous efforts to combat money-laundering and the financing of terrorism. The Syrian Commission on Combating Money Laundering and the Financing of Terrorism acceded to the Egmont Group of Financial Intelligence Units. The Group's membership includes the financial intelligence units of 108 States and is responsible for receiving and addressing reports of financial operations suspected of money-laundering or financing terrorism.

That is all the more so since Syria has suffered for decades under the scourge of terrorism and terrorist operations carried out on its territory, the most recent of which was the Al-Qazzaz operation of 2008. Council members will remember that the Security Council condemned that operation at the time. Syria reiterates that terrorism poses an ongoing threat to international peace and security. We also emphasize our commitment to the relevant international counter-terrorism resolutions. We are convinced of the need for the United Nations to play a central role in combating terrorism at the international level and in crystallizing an international consensus on this issue. My country is of the view that the Security Council's counter-terrorism Committees can contribute to coordinating the international effort to combat terrorism.

Syria, proceeding from its belief in the pivotal role of the United Nations in the fight against terrorism at the international level, cooperates fully with the three Security Council Committees established pursuant to resolutions 1267 (1999), 1373 (2001) and 1540 (2004). My country has established joint national committees with all the relevant organs to monitor the optimal implementation of those resolutions and to achieve the best form of cooperation with the Committees in their implementation. This cooperation is inspired not only by my country's interest in fully implementing the resolutions of international legitimacy and Security Council resolutions, but also by the urgent need to cooperate with the Committees with a view to eradicating terrorism.

  34. Any serious international effort to combat the phenomenon of international terrorism cannot disregard the need to combat State terrorism, which is the most dangerous type. A clear case in point are the crimes perpetrated by Israel against the Palestinian people in the occupied territories. This was made quite clear in Israel's aggression against Gaza and against Syrian citizens in the occupied Syrian Golan, and prior to that its aggression against Lebanon in 2006. Such State terrorism - not to mention the nuclear terrorism practiced continuously by Israel against all States of the region - is recognized as a documented and designated war crime and an explicit violation of international law, resolutions of international legitimacy, Security Council resolutions and human rights instruments.

  35. It is well known that Syria has been one of the primary victims of the scourge of terrorism and foresaw its dangers since its earliest manifestations. In the mid-1980s, Syria was among the first countries to call for the promotion of international efforts to eradicate international terrorism. In addition, it has called for the establishment of an effective global strategy to combat terrorism, including through an international conference under United Nations auspices to address that phenomenon by elaborating a specific and clear-cut definition of the concept of terrorism that distinguishes it from the legitimate struggle for freedom of peoples chafing under the yoke of foreign occupation. That right has been entrenched in international norms and instruments.

  37. As for nuclear weapons, it is an outrage; it is scandalous. A11 of us are aware of the situation - and incidentally, the source of the information is not Syrian but Swedish. All are familiar with this book, an international benchmark in nuclear disarmament and non-proliferation. Over 15 pages therein concern Israeli nuclear weapons. Israel possesses a nuclear arsenal made up of over 300 nuclear bombs, and nuclear missiles with a range of over 7,000 kilometres that can strike Europe, China and America. Israel is the only country in the Middle East that has not yet joined the Treaty on the Non-Proliferation of Nuclear Weapons. It has obstructed the establishment of a nuclear-weapon-free zone in the Middle East, an initiative launched by Syria in 2003 when it was a member of the Security Council.

Israel's allegations have a single, precise objective: to divert the attention focused on Israel's primary responsibility for the exacerbation of tensions in the Middle East and to divert attention from Israel's threats against its neighbours and the entire region. Yesterday, Israel prevented a Mediterranean- European conference from reaching agreement on the issue of the water shortage in the Middle East. The reason for the failure of the conference is quite simple: the European and Arab States referred to the occupied Palestinian territories in the conference's final document, and Israel simply does not recognize the existence of occupied territories. It continues to flout the Geneva Conventions and the norms of international law. The very mention of the occupied territories in that document was rejected by Israel in Paris yesterday.

  39. We also have to consider the option of setting up a committee that would produce a register in which we could record all the terrorist crimes committed by Israel since its creation. We recently witnessed the actions taken by the Mossad in Dubai. Paragraph 39 of the most recent report of the Secretary-General (S/2010/ 105) on the implementation of Security Council resolution 1701 (2006) states that the Lebanese Government "has not reported any breach of the arms embargo imposed by resolution 1701 (2006)". There are two reports, and neither makes reference to the transfer of arms and weapons across the Syria-Lebanon border, something that Israel claims.

Allow me to reiterate that the number of international resolutions adopted by the Council, the General Assembly and the United Nations specialized agencies against Israel are more numerous than the resolutions adopted by the membership on any other subject since the creation of our Organization. A great many Israeli political leaders, both military and civilian, can no longer travel freely because they are accused of having committed war crimes. This is a reality, and a truth that needs to be borne in mind constantly, both here in the Council and in other United Nations forums. It is high time to set up a commission of inquiry to examine all resolutions adopted by the United Nations since 1948. The result, it will be seen, would be striking.

  41. (spoke in Arabic) Allow me now to speak in my national capacity. Today, we have had the pleasure of hearing statements by the members of the Council that condemned Israel's actions and the unilateral measures it has adopted. It has done so in contravention of its commitments as occupying Power, as set out in the Geneva Conventions of 1949, the laws of war and The Hague Convention of 1907. These Israeli actions contravene the international community's will to establish a comprehensive, just peace in the region, with the creation of a Palestinian State within the 4 June 1967 borders. It would seem that the Israeli representative and her Government do not recognize the agreements commonly known as the Geneva Conventions, the laws of war, the relevant resolutions of the General Assembly or the 38 resolutions adopted by the Security Council.

The OIC calls for the intensification of efforts by the international community, including by the Security Council in line with its Charter responsibilities, aimed at accelerating the process of achieving a just and comprehensive peace settlement in the Middle East on the basis of relevant United Nations resolutions, the Madrid terms of reference, including the principle of land for peace, and the Arab Peace Initiative. The OIC reiterates, in this regard, its firm and unwavering support for the establishment of the State of Palestine based on a commitment to the right of sovereignty over the Palestinian territory occupied in 1967, with Al-Quds Al-Sharif as its capital, and a just solution for the plight of the Palestine refugees on the basis of General Assembly resolution 194 (III).

The OIC also joins the international community's stance in reaffirming that all measures and actions taken, or to be taken, by Israel, the occupying Power, to alter the legal, physical or demographic status of the occupied Syrian Golan and its institutional structure, as well as the Israeli measures to impose jurisdiction and administration there, are null and void and have no legal effect. The OIC demands that Israel abide fully and immediately by Security Council resolution 497 (1981) and withdraw fully from the occupied Syrian Golan to the lines of 4 June 1967, in implementation also of Security Council resolutions 242 (1967) and 338 (1973).

Thus, more actions should be taken by the relevant United Nations bodies, including the Security Council, to bring the Israeli perpetrators of these crimes to justice and to put an end to Israel's impunity and above-the-law mentality. The OIC remains deeply concerned by Israel's ongoing air and land violations of Lebanon's sovereignty, in breach of Security Council resolution 1701 (2006), and calls on Israel to withdraw fully from the remaining Lebanese occupied land in the Shab'a farms, the Kafr Shuba hills and the northern part of the village of Ghajar.

The OIC calls on Israel to end its collective punitive measures imposed on the civilian population in Gaza and calls for the immediate lifting by Israel of the unjust Israeli blockade and for the opening of all crossing points with Gaza, in accordance with international law and United Nations resolutions. This is the first time in human history that people are being prevented from leaving a war zone, seeking safety. The OIC welcomes the adoption by the General Assembly of its resolution 64/254, of 26 February 2010, on the second follow-up to the report of the United Nations Fact-Finding Mission on Gaza Conflict. The Group is of the view that that resolution constitutes an important step in pursuing accountability for these Israeli violations, which were confirmed in the Goldstone report (A/HRC/ 12/48).

The OIC Group calls on the United Nations, including the Security Council, to shoulder its responsibilities in taking the urgent necessary measures to compel the Israeli Government to revoke its irresponsible decisions and to refrain from any further provocative acts aimed at undermining the chances to achieve a just and comprehensive peace settlement. The Israeli Government, as all know, continues to ignore the international community's demands to lift the unlawful blockade it has imposed on the Gaza Strip for the past three years. The OIC condemns this inhumane blockade and expresses serious concern about the grave deterioration of socio-economic conditions and the deepening of the humanitarian crisis of Palestinian civilians.

Any provocative or illegal, unilateral actions against the holy mosque of Al-Aqsa will have very serious repercussions for the Islamic world and could incite another cycle of violence likely to destabilize the region and the rest of the world. The OIC Group strongly condemns the Israeli Government's decision to usurp illegally Al-Haram Al-Ibrahimi in the occupied Palestinian city of Al-Khalil and Masjid Bilal in the occupied city of Bethlehem. The OIC Group stresses the illegality of the Israeli Government's decision and considers it as null and void and without any effect whatsoever.

The OIC members reaffirmed, at the thirty-sixth ministerial meeting held in Damascus, that all Israeli colonial settlement measures and practices in Al-Quds and the rest of the occupied Palestinian territory are null and void, and requests urgently the Security Council to revive the International Supervision and Monitoring Committee to Prevent and Prohibit Colonial Settlement in Al-Quds and the Occupied Arab Territories. We strongly condemn the attacks by the Israeli occupying forces perpetrated against Palestinian worshippers at Al-Aqsa Mosque and the Al-Haram Al-Sharif compound in Al-Quds Al-Sharif.

The OIC Group demands that Israel also abide by resolutions 242 (1967), 338 (1973), 1397 (2002) and 1515 (2003) and withdraw from the occupied Palestinian territory, including East Jerusalem to the lines of4 June 1967. Despite the unanimous international rejection of Israel's de facto annexation of A1-Quds Al-Sharif in 1980, and despite the strong calls for Israel's immediate cessation of all colonization measures, Israel, the occupying Power, continues its illegal campaign geared to changing the Palestinian Arab identity of the holy city of Al-Quds.

These violations are the most prominent evidence of the policy of ethnic cleansing and aggression being pursued by Israel, the occupying Power, and of the intention of Israeli decision-makers to wage a fatal war on the peace process and to undermine international efforts to bring a just and comprehensive peace to the region. The OIC strongly condemns these Israeli violations and calls for the immediate cessation of all such activities, in accordance with the occupying Power's obligations under international law, including the Fourth Geneva Convention of 1949 and the many relevant Security Council and General Assembly resolutions. In this regard, the OIC recalls, inter alia, Security Council Resolutions 446 (1979), 465 (1980) and 478 (1980), which all remain valid and must be implemented.
